But to be able to blame the collision on using the phone they would have to be able to time the collision to within a second or so and be able to match that with the phone being in use.Easy to get the logs that the call was interutpted.

I am not clear about exactly what you mean but almost all convictions are covered by the Rehabilitation of Offenders Actwhere would some one go who has been offered that deal to get the conviction they did plead guilty too removed from record?
