I really feel like screaming, my dad is going to phone her tomorrow then my dad is going to call me and I will then email any unanswered questions.

I STILL havent been told what exactly they want to dismantle, I STILL havent been given a copy of the defendants engineers report. I STILL havent been told who is going to test the torque of the bearing.

End of the day its still my car, its my property and I have a right to know whats going on. My solicitor is clueless and the whole thing is getting me seriously stressed, especially when my emails have been getting ignored and then when she does eventually email back, she picks and chooses what she will reply to.

I cant emphasize enough how much this is getting to me. This is more stressful than having the accident, at least i was high on morphine then :rolleyes:
 
Is there anyway of calling a face to face meeting with your solicitor in an attempt to resolve the internal issues?

Anyway.... another update :rolleyes:

I emailed the Solicitor today, she hasnt bothered replying but if she dosent answer my questions in the next day or so, she will get a call.

She left a voicemail yesterday on my dads mobile so he called her back earlier this morning.

He told her we weren’t paying for them to have the car taken to fiat, she agreed we shouldn’t pay for something they have requested (arrgh – why didn’t she argue this in the first place) :bang: :bang: :bang: :bang: :bang:

Then she asked my dad what the engineer was called that the insurers got to look at the car??!!! :confused: My dad said he didn’t know.

Then it turns out the guy the insurers got to look at the car said he didn’t know anything about “these types of cars” so this is why they have decided for it to go to fiat.

This whole thing is a mess, how can they let someone look at a car that they haven’t a clue what they are looking at? I feel like screaming. This whole case is a ****ing joke. I stand no chance of a fair investigation is no fecker has a clue what they are doing.


I must be the most horrendous person to be around atm, I am getting really annoyed with all this and am constantely in a bad mood. I have no one fighting my corner except me. My solicitor doesnt have a clue

I meant between me and the garage. The solicitor is supposed to be helping and advising me, but when she is telling me that I have to pay for things that the defendants requesting without even dismissing it until it has been raised by me then what use is she?

Thats basic stuff, if i didnt have a clue and went by everything she has said then i wouldnt be getting anywhere.

I would have thought the first thing she would do is contest that i have to pay for something they want. But no, she wastes time and emails me. Then when I refuse goes back to thier insurance and see what they say. It should have been sorted out there and then when they said i had to pay :rolleyes:
 
To be honest taking it to Fiat will probably be in your interests as they will be slightly biased towards any work carried out outside the franchise network. All the delays are standard practice for legal process as they are trying to make you give up. Don't let it wind you up and put your solicitor under as much pressure as you are, it will be an incentive for her to get on with it.
 
Any chance you can go to another solicitor? Ask her for their complaints procedure. Let them know by no uncertain terms that you are unhappy with their service. Sounds like someone has undeclared interests. Well actually the interests are self evident.. The more time your solicitor wastes the more they get paid.
 
I gave her a bollocking by email, i have set a list of questions that I expect an answer to. If i dont get an answer then I will phone her up and get her to tell me why she hasnt replied to the email and ask her the questions.

I have also pointed out to her she dismisses important things i need to know.

I have asked her why in her emails does she always say there has been a confusion, I have asked her to clarify things for certain before giving me information that isnt correct, I challange it and she goes off to find out the correct info.

She hasnt replied to my email yet, I have also mentioned that she stated the defendants have 3 months to investigate liability on their behalf. It will be 3 months at the end of this month, so what will happen if they havent got any further?

I have never had to experince anything like this thank god but what I would say with regards to emails is that you are giving the recipient a chance to ignore or skip past any questions that you have asked to be answered.

I know it is a pain in the a*se but give your solicitor a call and then run off your list of questions. It is a lot harder for someone to ignore your questions when you are actually speaking to them rather than just sending them your questions via text format.

I know by experience of working in an office that you can skip past emails or answer them later ect if you dont feel like doing it at the time where as if someone calls me up and asks me someone I feel that I have to answer them there and then.

Just a thought but I think it might save you a lot of back and forth actions and running around chasing your tail pulling your hair out while waiting for a responce.

Im only young so what do I know but hey it might actually work, all its going to cost you is a little bit of time and the cost of the phone call.

Anyway hope you get it all sorted soon.

I send emails and I also call her. I do prefer emails because everything is documented, if she says something that doesnt match up with what she has said before I can read back and pull her up on it.

I went TPFT once because I was made redundant and couldnt afford FC and boy am I paying for it now

I have to agree with you completely on that statement.

I do the same at work with anything relating to external companies because there is always someone out that who is trying to screw you out of money :mad:

It might be time for you to consider recording your telephone conversations for this exact same reason :idea:
 
it must be gutting that everything is still going on. really feel for you sammi. as though the initial experience wasnt bad enough for you & everyone else in the first place.

will make sure we pack plenty of wine for the camping weekend so you can try an relax abit. :)
