Sorry if this is in the wrong place but I need some advice.
Basically I live on a street that has little parking available. I came home after 12 midnight yesterday night and the only parking space I could find was on a path. I have taken pic of the path. I was parked on the brown bit, right at the edge so not near the corners edge.

I got a penalty notice this morning. It states "parked in a restricted street during prescribed hours". My street does have restrictions placed upon it but thwy only apply august to may (football season).

Do I have any grounds for appeal? Considering the restrictions and lack of parking?

I would appeal on the grounds that you had been working late having being helping disadvantaged members of the community all day and having gotton home after midnight you were at a loss to park
throw your self on the mercy of the adjucater and say you understand the reasons why it was wrong and will never do it again
you could have got the more serious charge of obstructing a pavement you see
ive only got one parking ticket in my life and it was very similar to this one
 
Yellow lines apply to the pavement as well as the road. See the attached download from the Highway Code, page two, in the text at the top.

Yellow lines are primarily there to reduce obstructions on the road, to keep traffic flowing, but the rules allow their use to control pavements too to keep visibility. Whilst the lines in your case may have been there for the road, all the rules apply and the warden was a happy bunny that day.

You're lucky you didn't find some scally had nicked you wheels & left in on bricks living round there.

There's a thought, take the wheels off, claim someone's nicked them, grounds for appeal.
Sadly, they take photos of the wheels, for the valve positions, so they can see if it has been moved. If not moved, a ticket lasts 24 hours, if moved, they can issue another immediately.
There was a time that Oxford car park charges were so high, and a yellow line ticket £15 if paid within 7 days, that it was cheaper to park on a yellow than in a car park.

Also mention crime stats (recent ones are best) in the area and that you were worried for your safety had you had to park too far away at that time of night...Unless you're a 18 stone skinhead with ACAB on your knuckles it will help.

I successfully appealed one stating I parked in close proximity to the job I was working at the time (removing IT Equipment) and if I had parked in a designated area it would have left myself liable to injury, my vehicles contents liable for theft and my clients confidential data at risk of theft. I then stated it would leave me liable for a breech of the data protection act blah blah. Didn't hear a dickey bird after the initial letter lol!

Im sorry if I offended you, you who doesnt live in my street, you who doesnt park you car in my street, you who comes on here with a sarcastic comment, truth or not. You who doesnt understand the parking situation in my street. Have I covered everything? Just so you can keep your "im saying this so I get some sorta karma" attitude, I spoke with a person from the citizens advice bureau who said that an appeal would likely be successful based on the fact that parking is already an issue in my street. And there are preliminary plans on removing said bits of pavements to increase parking availability. That said the process would be lengthy and if the process got passed to nto (some sort of bailiffs I presume) I would still have to pay their costs.

All that in mind I went to my local council office, submitted a complaint along with pictures of the street at various times (12 midnight, 10pm, 6pm) which shows parking availability or lack of, and other road users useing pavement as an option to park. (Numberplates blanked out)

Oh and I payed the fine of 35 pounds.

So mr custard thankyou for your very informative and frankly amazing waste of 10seconds of my time in reading it and I hope all is well in your little perfect street :) ?
 
Dumping your car on a pavement isn't parking.You don't understand that as you no doubt feel people are perfectly able to walk around your car but you can't walk from it. My street has limited parking too. I don't feel my car should be dumped wherever simply because there is no space near my home.

I dont feel like my car should be dumped where ever. Enlighten me. Tell me how you came to that conclusion. Id love to know! If I felt my car should be dumped where ever id parked it on the pavement infront of my house. I didnt. For a few reasons actually. I asked for advice in my original post because I didnt understand that yellow lines governed the pavement too. An oversight on my end. And the code they used (code 1, parking in a restricted street in prescribed hours, or something like that) threw me a little as the restrictions as I stated run monday, thurs, fri, sat, august to may. It was only after doing some research, AFTER posting the first post that I realised it also includes dyl.

So mr keyboard warrior before you post another "im holyer than thou" (sp.) Reply at least consider all the facts.

Oh and fyi its not that I dont like it. I have respect for the rules lf the road. You dont seem to understand that I genuinely didnt realise it goverened the pavement. And I was asking for advice. It was all good untill you came along with your sarcastic comment. People had even said I was in the wrong before you came along.
