But what I mean is I'm not sure if this might already be the case of it needing a new MOT after a VIC?

Strangely not, at least from the perspective of the Road Traffic Acts. The act of an insurer making a Cat C declaration does not in itself invalidate any existing MOT. Remember an MOT is only a statement of the condition of the tested items at the time of the original test.

However, it is always an offence to drive an unroadworthy vehicle on the road, irrespective of whether it has an MOT.

The car needs to have insurance and, if over 3 yrs old, a valid MOT before you can drive it to VOSA for a VIC inspection but AFAIK there is nothing in the regulations to prevent the old MOT being used if it is still in date.

Remember though that the vehicle must also be reinsured before it can be driven on the road, as when an insurer declares a vehicle Cat C they will no doubt also cancel any remaining insurance it may have had. Before issuing a new certificate of insurance, the insurer may (and probably should) require a new MOT as a condition of providing the insurance.

The VIC inspection is only concerned with the identity of the vehicle and neither the quality of any repairs nor the vehicle's roadworthiness are examined (though VOSA will likely issue a prohibition notice if they spot something obviously dangerous).

Again all depends upon the quality of the insurance company, some decent ones will suspend a policy until you obtain a replacement vehicle, or will continue to cover if you keep the vehicle :)
