I posted this in the insurance forum too but I figured not so many people look at that. I am hoping someone can guide me here.


I am so upset right now.

As some of you know I got a Smart car last year. It was insured with CIS. I mistakenly left my son to sort out the insurance and he forgot to protect my 11 YEARS no claims.

In December 12 someone reversed out of his drive into my car as I was driving down the road. There was no damage whatsoever to my car and a scuff mark on his, but he threw a tantrum in the middle of the road and said this was going to cost ME a lot of money. So I went home and called CIS and they said that it was going to recorded as INFORMATION ONLY and no action would be taken as this was clearly not my fault. He later tried to get me to pay privately and I told him to stop harassing me or I would report him to the police and I never heard from him again.

So as far as I am aware there was NO CLAIM MADE.

Then a couple of weeks later my son, who was named on my policy but also had his OWN policy - drove his Stilo (insured by him) into a bus on a roundabout. I did not report this to my insurance company as it was his car and dealt with by his insurance and as things turned out no claim was made and he has managed to insure again recently and nothing came up on the database as recorded against him.

Then in March, my car was parked in a side street not far from my house while I went to Tesco. I came back to find the passenger window and glass tailgate smashed in. My other son had left his iPad in the car and that was taken. I didnt know he had left the damn thing under the seat but we have since found out that several cars have been broken into in that spot as it is not overlooked by any houses or cameras.

I called CIS and they said that I had glass cover and would need to pay a £50 excess and they came and replaced the glass and said it would not affect my no claims. I did NOT claim for the stolen iPad as I knew it would affect my insurance and its his own stupid fault for leaving the thing there.


On Friday I sold the Smart car and bought a newer one which is also a convertible - something I had always wanted. I called CIS and they could not offer me a competitive price compared to online quotes I had received so I cancelled the policy.

I then called Morethan for a quote and this is where it all went pear shaped. They insisted that the glass breakage was a fault claim because I had never had the excess refunded. I said this was ridiculous as you never get the excess refunded on a windscreen replacement and this was just a different piece of glass on the car.

I then called CIS and asked them if they had indeed recorded this glass breakage as a loss and they said no, you were covered and it doesnt affect your NCB. I then asked him how much NCB they had on record for me and he assured me that it was 11 years and they would send me a letter to confirm this. So the company that I was insured with when all of these incidents happened are telling me that I have 11 years NCB. He also asked if I wound like him to give me a NEW quote as it may come up with a better figure than just changing the car on my existing policy. I agreed and he came up with a figure of £550. I have found quotes online for £450 so this was still not competitive so I thanked him and decided to keep looking.

So today, I call the AA and get a quote and the man I spoke to was really helpful and he checked the insurance database while I was on the phone. The CIS have recorded ALL three incidents as FAULT claims and this has wiped out my NCB and the figure for insurance is now £3000.

I am so upset.

dont know if you can do this, but request a copy of the conversations.

I'd do the childish thing of phonoing cis everyday till its resolved, since they have clearly lied to you
 
I would suggest that you get CIS back on the line, and escalate it up the line as far as you need to do until you can get in writing what has been told berbally to you already.

You're getting fault, none fault and claim all mixed up.

Fault and none fault are often incorrecly used, you need to think of it as loss or recovery. If a claim has been paid out and its not recovered from another party then its gets noted as a loss. A lot of people / companies will refer to this as an at fault claim, even though no blame really lies with you, its only because they can't recover the claim costs.

What has happened sounds right to me, just because CIS don't class it as an at fault claim doesn't mean that other insurance companies cant / won't. Ultimatly its a loss, and some companies will load your premium for this.

At least you've still you NCD though.
