Someone Rear-Ended me

Hi Brava,

I had a similar accident a few weeks ago where a woman mindlessly drove into my front bumper on the drivers side.. she started shouting at me and refused to give me any details.. so I took a picture of the number plate and reported her to my insurance.. they told me to report her to the Police so I did. Felt very good to get my own back! (y)

But as others have said, be aware of any injuries and make sure you get a pic or note of the reg plate, even if nothing else.. and remember that refusal to give a name and address is a criminal offence whereas not giving insurance details is not.

Hope you and car are safe :) Lozzie xx

Gutted for you.

It's 100% her fault. Don't worry about not having her insurance details, as long as you have the reg, your insurance should be able to deal with it. Have you contacted your insurance?

Did you get lots of pictures of the accident?

Hi

Yes, I've contacted my insurance ... and hers. I took two pictures at the scene (one of both cars). I am going back to take more pictures of the road layout etc.

Thanks Lozzie :)

I'm OK at the minute, but my car isn't too good. I'm getting some garages to look at the damage tomorrow, and give me some quotes. It was my dream car :(

I phoned her this evening and she is still saying that I shouldn't have stopped!

That sucks, but as everyone else has said, its completely her fault, were there any other witnesses or just you to? That could help alot. Thats whats missing from my insurance battle, been over 2 months its still going on.

I dont see how she could win though.

Hi

There were no witnesses at all :(. Was yours a straight forward rear-end collision, or more complex?

Generally the assessors can take one look at the damage and tell its a rear ender and the set of extenuating circumstances for someone to not be liable for hitting you in a rear ender are TINY. It'll be OK. From experience women have such poor spatial ability they seem to assume any crash they're in is someone else's fault *awaits lynching*.

Bad luck mate. It's all the hassle and stress that these needless events cause that is so annoying. Just bear in mind that just like any unusual muscle activity, a whiplash injury can easily take 48 hours to take effect. Watch for head aches, difficulty concentrating, shoulder and back pain. If you are inconvenienced by this in any way, then tell your insurance company. If you lose time off work, then likewise.
Good luck and ignore the silly woman - she can't think of anything else to say as she hasn't got a prayer. Is she definitely insured?

Wrong, you only have to supply a name and insurance details ;)

Address is not a nesseity (sp?).

I phoned her this evening and she is still saying that I shouldn't have stopped!

Why did you call her? I'd advise against having any contact again as it could go against you legally at some point. Leave it with insurance.

Hello :)

Yes, she's insured. I am having great difficulty "switching off" from the incident ...

You'll get banned for saying that :p

It wasnt as bad as yours, he reversed into me, on the spot he admitted it was his fault but i have no proof, took his number plate and insurance, my insurance have all of his details but cant get hold of him, we decided to get my car sorted ourselves, saved about £800 doing that, and if he does admit liability i get £800 from his insurance.

Was any places near by that would of had CCTV?

Banned'd be a far worse threat than what I got last time I said that (something along the lines of "You'll never find a woman with that attitude!" Like thats a major concern!)...

I thought refusing to accept contact from an insurers was basically an admission of guilt? My dad's Grande got rear ended by someone (who I later found out to be the owner of an internet TV service, so who likely hasn't two cents to rub together, but did have insurance). After two weeks of him refusing the answer the phone to his insurers they paid out in full "with no admission of liability"

A slight variation of the above.

1. Make sure anyone injured is taken care of.
2. Note down: Make, model and colour of car.
3. Note down: Registration number. (check this against the one on the tax
disc)
4. Never accept blame. (don't even say sorry as that is a tacit admission of
liability even if blame is in doubt)
5. If the Tax Disc is out of date or the reg. no. doesn't tally with the car, call
the Police.
6. Obtain the name and address of the other driver.
7. If you have a camera phone or camera, take as many pictures as you can.
8. Collapse on the floor writhing in agony (Only joking)
9. Don't worry about Insurance details as most people don't carry them with them.

Quite a lot to remember for the future.

Thanks for that, never really known what to do if I do crash...only had two, one was no damage (walking speed), second the other driver drove off, but reported it to the police just incase.

No CCTV .. nothing. Waiting to hear from her insurance company. What kind of questions will they ask me? I suppose I've got to be on guard ... they'll try to twist my words around ... bloody tight fisted weasels!

Why pay hundreds of pounds a year just to be treated like a criminal, and wait weeks/months to have anything done? (n)

This is my last input for a while. I am honest, and I will not feign injury etc. However, if this woman or her insurers dispute anything .... I will give them the mother and father of all court battles

Don't worry too much, when a similar accident happened to me a few years back I had the cash within a month.

My only input was "hello Mr insurance hotline bloke - I've just been hit up the rear by the driver of a Golf, reg number *******. I stopped at some lights and she didn't. Her insurers are ************.
The reply came back "Thank you, is your car driveable?"
"No, I got it home - but it's lost most of it's back end"
"We will pick it up from your home address later today then - your courtesy car will be dropped off at the same time" "We will send you forms to fill in, please email any pictures you have to us".

Next I heard was 3 weeks later to say it was a write off (which I knew already) and that the cheque was on it's way. This was a "no fault incident for you, Mr H".
Oh, and give us the courtesy car back.... please!

Just be honest, make it easy for them and there will be no problems.

Wowowow. Thats a long way off yet ;)

Just be honest, make it easy for them and there will be no problems.

Providing they're not like the majority of companies, and there will be no problems other than crap payout if you let them walk all over you. (n)

My sister had a crash like yours. The person that went into the back of her said she shouldn't of stopped, even though there was a car coming. My sisters car was a write off, and looking at it you would not of thought it was, only had a small dent on the back.

When the insurance company came to view the damage, they didnt even ask for the keys/to move it out of the driveway. Just took about 2 minute look at the back and declared it a write off. So these can be a pain in the arse if you get an idiot who doesn't care.

In the end my sister did get compensation for whip lash, but their insurance only paid what the car was "worth". She got £400 for a saxo furio. She paid £1,000 for it two month before.

Ah, but then again more fool your sister for accepting £400 ;)

Insurance companies do and will walk all ove you if you let them.

Tried it with us, and after alot of strong words though exceptional circumstances we got £1400 for a 1993 Panda worth £750 :p
