In January I had a big clearout and listed a lot of stuff on ebay. One of my auctions was for Pandora bags and boxes. I had quite a few of them sitting in the loft and noticed that people were selling them on ebay so I figured why not?

For anyone who doesnt know what I am talking about, Pandora is a high end jewellery store that sell charms and other jewellery. I have a bracelet and my kids had bought me charms at various times to fill it.

I ended up selling 11 boxes and 11 bags for £35. A week later the buyer opened a dispute and said that they were significantly not as described. He claimed that I had sold him earring and ring boxes which are exactly the same as charm boxes but with a different insert. I argued that my listing was for boxes and bags and I had not even described the inserts and I also had all the receipts to prove that the boxes came with charms. He then said that FOUR of the boxes had the wrong inserts.

This seller is using genuine Pandora bags and boxes and selling them with a fake cheap charm. They are also buying up hundreds of bags to do this. The people buying this stuff could actually buy the real thing for the prices they are paying for his fakes.

So, ebay found in favour of the buyer and told him to return my stuff and they would refund him. The package arrived this morning and the whole scam became apparent. He sent back 11 bags and 11 boxes but they were NOT the ones that I had sold him. The ones that he returned were dirty, battered, smelled of cigarette smoke and ALL of them had inserts for rings and earrings, none for charms.

It is clear to me that the buyer kept my good charm boxes, pretended I had sent him the wrong thing and returned all the boxes to me that he could not use. So he got all my stuff for free and I am left with a load of stuff that is unsaleable.

I have appealed which is the only option left but I am not holding my breath. They seem to allow this kind of thing to go on. So its not just buyers who get ripped off :(

You've got their address right? Send a load of stuff without stamps...heavier the better, if they are always buying stuff they'll think its stuff of eBay.

How did they post it to you? Was it recorded at all? I would be tempted to say nothing arrived.

Yes it was recorded, that is a condition of returning stuff. Once the buyer produces a tracking number and that has been signed for, the money is refunded.

This is one of his listings:http://www.ebay.co.uk/itm/230724161863#ht_500wt_1038

You can buy a genuine Pandora charm for £25. He just words the listing so that unsuspecting people think they are getting the real thing when the only genuine Pandora thing they are getting is the bag and box. I reported this to ebay and he is still there so I am assuming they have done nothing to protect unsuspecting buyers either.

This post contains eBay links which may earn a commission at no additional cost to you.
I have reported him too for selling potentially counterfeit goods using a misleading description, I suggest many more people do the same.

If eBay will do nothing then I would open a small claims case against him for £35 plus all associated costs.

Thanks for doing that Andy, I just googled counterfeit charms and there are reports that some could be toxic and if they end up going to little girls this could be a lot more serious. So I urge everyone to do likewise.

On an upside, I just received this email from Ebay in the last few mins:

So the moral of this sorry is fight to the death!

Thanks for all the responses. He will no doubt leave me a negative feedback now but I am past caring.

I'm surprised you got your money back, but I'm glad. A very similar thing happened to me, and I ended up losing out on £130 despite fighting it to the death!

I'm glad his listing has been removed now as well.

If he does leave you a negative feedback you can appeal against it to have it removed, I've done that before and it worked.

go to your local police station and file a report

I would, but the police stations around here are more like refugee camps / homeless shelters and I would probably be looking at spending the next 2 - 5 hours waiting to even be seen. I am not going to use ebay to sell anymore. I will keep my account open for purchases only.

I got another email from ebay and I dont think they took the money back from the buyer, I think they just reviewed the case and sent me the money from their own funds or maybe I am reading this wrong?

They sent this:

Hello Fiona,

I am writing in response to your previous contact with our eBay Live Chat Help about the charm boxes and bags (item 110803493518) which was purchased by "gemisons2011." After reviewing your chat transcript, I understand that you are concerned about a case your buyer opened where you have received the item back in a condition that is not the same as it was sent. I understand your frustrations with the outcome of this case.

Fiona, I have seen that you have appealed our final decision because the buyer returned the items differently as it has been originally sent.

As a valued eBay member, we would like you to get help when you need it. And for this reason, we have granted your appeal as a one time courtesy. However, the next time that this occurs, we will be requiring you to submit documents such as police report stating that you have received a a faulty return from a buyer. The payment for this item should be credited back to your PayPal account within 3 days and the hold on your Paypal account should be released now.

We appreciate your patience and understanding to this. If you have any other questions or need further help, please let us know by replying to this email. Thank you for choosing eBay, and may your purchases run much more smoothly in the future.

Kind regards,

Amerie E.

don't forget to add him to your blocked bidders list (find it in site map) that way will help to stop him trying it on again or just trying to leave you a neg

He is on my blocked bidders list, and also blocked from even emailing me. The whole thing stressed me out to be honest because I dont set out to rip people off and it felt like I was helpless to defend myself against the abusive emails and accusations. So far no feedback has been left on either side.
