okay so I borrowed my mum's car today, got a parking ticket for 'unnecessary obstruction' are the right? i don't think it's on the path is it? surely it's on the drive of the (at the moment) out of use building which is private land, and I didn't think they could ticket on private land. advice, Appel?

Need a better picture of the wall / boundary of the site. You sure it's defo private land?

the wall comes further out towards the road and the parallel with the pavement, why wouldn't it be? surly it counts as the driveway? although I am over the part of the dropped curb? the only way to appeal is to go to court, then if I lose wouldn't I have a court fee? I just want a better explanation than 'unnecessary obstruction'.
 
Assumptions are the mother of all balls ups, never assume something is private land just because a wall extends. Might me common land or no mans land so to speak.

I didn't assume because of the wall, I assumed because its a different surface to the rest of the pavement that continues up into and beyond the gates :/

I've a plot of land out the front of my house. Looks like its mine, but not on the deeds of the house, turns out its part of the roads old turning circle before the road was extended, but to the untrained eye you'd have thought its mine.

I'd try getting in contact with the land owners of the site to ask.

If i recall correctly, Council or Police are the only fines you are legally required to pay.

Private companies like P4 Parking etc, only issue "invoices" and you have no legal requirement to pay. I have a drawer with many from P4 Parking as they "patrol" my brothers area. Not heard anything from them in over 8 months, and I still regularly park there.....

and you say there is a pathway for pedestrians along the road then your car being parked where it is means that I would struggle to get past it and would probably have to step into the road? thus causing an 'unnecessary obstruction'

if it were necessary to park there i,e loading then you could have parked temporarily on the double yellows but i'm guessing you weren't 'loading' and if your car had been there a long while then that argument would most likely fall on its face as well
 
Also if that pic is of where you was parked a disabled person in a wheelchair or mobility scooter has no hope of getting past so your appeal is gone right there

Very poor and inconsiderate parking for me - get your ticket paid and learn from it

Give us a google maps link and it might shed different light on it, but based on that pic I'd say you parked like a gimp and need to pay up. But as already mentioned I'm making several assumptions, if we could see the rest of the street it might make more sense.
 
I'm wondering what would happen if access was needed to the building in the event of a fire or something similar?

Maybe that's why you were considered to be causing an obstruction?
 
You look like you are clearly blocking the right of way - I would have to walk my kids in the road to get round that.

Would you be happy pushing a buggy / wheelchair & come to a car parked deliberately on the foot path where pedestrians are supposed to be?
Why didn't you park somewhere more sensible?


Not all parking fines are enforceable though.

If a ticket is issued by the police or council then you are in the hands of the law & you need to follow the given procedures to get it sorted.

BUT.........!

Get a ticket from overstaying in an Aldi - Mcdonalds - Lidl - Shopping centre - etc etc (Public / communal although private property kinda place) You'll most probably get a ticket from a private ticketing company.

Don't ever think of private parking tickets as "fines". They're not. These companies have no official right to fine you, though they may try to make you think they do.
All they're doing is sending you a notice for what they deem as a breach of contract.

This type of ticket is an invoice - Do not pay, Do not pay, Do not pay.

These 'fines' are not fines, they are invoices and as such are unenforceable.

Ignore them at all costs and never acknowledge them

They use - payment of the "parking charges" will be taken as acceptance of the breach of the terms and conditions for parking in the named car park, and that the information contained herein is entirely accurate. As an onus on you accepting the contract.

Appeal them (if you want to - Although you will be acknowledging the ticket) stating I never had a contract with you so how can you try to get monies from me for a contract I never signed..????

Many forums have sprung up re: theses scumbags. I have 2 such tickets from the local Aldi - I overstay on purpose now.

Is there even a pavement there? To me, it looks like this;

Red is pavement. Blue is fence. Green is fence. Yellow is factory. He parked in the white bit.
