Insurers are in business for money, and will pursue the most direct course if an accident could be attributed to illegal headlamps.
I can't therefore see them hunting through a car's ownership history to track down the guy who originally installed illegal bulbs - they will always hit the current owner, because they're far more likely to hit the jackpot that way.
Onus is therefore on the current owner of the car to make sure it complies, arduous though this may be.

It all depends on what's at stake.
A dented wing and a few hundred pounds of damage and I seriously doubt anyone is going to look closely enough to spot illegal bulbs.
Once significant personal injury comes into the equation, it'll be a different story.
In the most serious cases, the insurers will be the least of your worries.

That accident had nothing to do with lighting, but if you were unfortunate enough to dazzle an oncoming driver and they then crash down a railway embankment, take out two trains and about half a mile of a major rail route, you will pay a high price for your 100W bulbs.

Guess 'burden of proof' makes a big difference.
It would be no use bleating, after the event, that, 'I didn't fit them Guv - I bought the car like that.'
The insurers would normally look no further, and you would get stung.
It would then be your responsibility to track down the guy who fitted the illegal bulbs and recover your losses from him. Simple, not!

I thought that was just me.
I've always been tempted to carry a baseball bat in the boot and just get out in traffic and take a single swing at each light unit.
Then I remember that if I do I'd get more time inside than I would for murder.
My pet hate is people in front of me keeping their foot on the brake pedal waiting at traffic lights.
Big bright stop lights can be awful shining straight into my eyes, and I'v often though of getting out of the car and tapping on their window and asking them to set their handbrake and take their foot of the pedal.

try stopping with an extra 4 foot between you and the car in front, makes a lot of difference
Not with some of these LED units, I agree with Mick F partly, but half of the problem is how cars are made, automatics with start stop for example, take foot off of brake, even with handbrake on (Alfa with TCT gearbox as an example) and the engine will restart :bang:
I do try and make a conscious effort not to sit in drive with foot on brake in the Prius though.
Most new cars come with hill start assist which requires you to keep your foot on the brake so this problem is only going to get worse.

I'll reiterate so the record is straight:
I swapped the full beam bulbs in our Clio for higher power ones. Our Clio has twin headlamps ie the dipped beam is in one pair of lamps, and the full beam is on another pair of lamps.
Dipped beam is used 99.99% of the time, and they are normal dipped beam bulbs.
Full beam is only used on the open road out of sight of leading vehicles or vehicle coming towards. Back in the old days, you could go down the motorway on full beams at night, but these days there's so much traffic that one rarely uses full beam even on B roads. I'm willing to bet that people who live in the Big City never use full beam.
As for brake lights, they are bright for a reason. Cars have high level brake lights for a reason too. Stopped in traffic, there is no need for anyone to have their footbrake continually depressed. People should read the highway code perhaps?

Those are the laws for the use of your lights, not the laws pertaining to the construction and specification of said lights. THEY'RE ILLEGAL FOR USE ON A PUBLIC ROAD, SIMPLE AS THAT.

You're making the typical mistake of thinking that the highway code is the only thing that dictates what you can and can't do on the road.....
I'm not making any mistakes with respect to the HC and what should be done on the road.
I said that I am annoyed by people stopped in traffic with their footbrake on. The HC is quite specific on this subject. I also suggested that people should read it. There is no excuse for either.

You're also not contravening anything in the Geneva Convention on Human Rights by using 100w bulbs, still doesn't make them legal....
You're not too young to understand, you just seem wilfully ignorant of the rules and laws of the land.
