Twice a complaint has been made about the gearbox while still under warranty. There will be documented evidence of this, so the warranty should still fix the problem.
There should be two job cards noting your (the owner's) complaint, hopefully you have copies, but if not, you should have the exact dates, so the garage can find theirs. The issue of the garage not diagnosing it is their problem, not yours, they are the expert, not you. You have done the right thing by noting a fault, any subsequent damage is due to their inadequacy.
If the warranty was through a third party warranty company, talk to them. If it was a warranty given by the garage themselves, that may highlight a reason why they were apparently "deaf". That situation is a little more difficult.
Either way, you may need help from any or all of Citizens' Advice, AA or RAC, legal expenses from your insurance (worth a try) or trading standards.

Contact the garage and state that you expect it to be fixed as you complained within the warranty period.
Contact the warranty company and ask for their help. If they try to offer less than the full cost, the garage should cover the difference.

Be firm but always polite. Don't lose your temper or shout. If first visit to garage is unhelpful, revisit at a busy time where other customers will overhear your conversation.

A gearbox can go on any car at any time. My wife's Mini (BMW) went at 40,000 miles.
I've never had any problems with any gearbox in any of my Fiat or
Alfa's (two Uno's, three Punto's, Bravo 1, Bravo 2 and a 156).
The secret - don't rush any gearbox and change the gearbox oil at every other service.

But BMW Mini's had a well known gearbox problem originally though didn't they?

I think your right but My wife's was a 2008, driven easy, full dealer service.
Thank god we took out the extended warranty.

Yep, mine's a '58 with a complete dealer warranty, the gearbox bearings are noisy. I got a 12 month warranty with mine, they're still refusing to fix it though.

I think you need to escalate it beyond the dealership. If there's a fault and there's a warranty, it gets fixed. They can't just refuse like that.

I'd complain (but nicely) to Fiat UK (00800 3428 0000) and if no joy i'd consider speaking to Citizens Advice, Which? Legal, Auto Express, What Car etc. It seems to have been going on a long time now & the clock's ticking so you need to think about whether you really want this sorted under warranty & how you're gonna go about getting that, because there's a limit to what we can do on here, but Fiat UK and Which? What Car etc have a lot more clout.

Yes mate, it's the M32 alright. I rang fiat last week and had that verified on mine. Mine is a 150 Tjet. Cost new, £3318 I do believe I was quoted. Give or take a couple of hundred.

Ahh thanks for that, Im just looking a replacing the clutch to a more durable version, like a Carbon Kevlar one, and there seems to be some already made for the M32, which should make it easier to get hold of, but the only ones I can find seem to be 1.9 Diesel clutchs, but I cant imagine this being a problem if they are 6 speed.

Here's a little tip, you may already know this, but search for vauxhall M32, everything seems to be cheaper. Even a new box from vauxhall is only £2500 ish. Just a suggestion.

Phil.
