ok here goes! if you owe a bank money and then they sell it to a collections agency and the collections agency doesn't exist however they have another company collecting the money for them what would you do ?
 
lol the thing is they are trading as a limited company however there is no record of them. the compnay that is collecting on behalf of them will not supply me with any details of this company and everytime i ask them who owns the debt they refuse to answer. i believe that if the debt has been sold to a company that doesnt exist why should i pay them because there breaking the law by trading under this name and especially as a limited company

I would just ignore it if it was me
 
the name of the company that have bought the debt is phoenix collections (uk) Ltd there is a pheonix collections comapny but they are commercial collectors and when i rang them they said they have had many people ring them and after investigation this phoenix ltd company does not exist and then i find out that they are not registered. the company collecting on there behlaf is fredrickson
 
dont deal with them on the phone.
put it in writing to them(by recorded delivery) that you will only communicate in writing and to not phone you.
after this they legally cannot phone you.
also ask them to supply you with a copy of the credit agreement they are trying to collect on.
again by law they must supply this within a set time frame.cant remember exactly but its like 14 working days.
without this they cannot collect the debt,however you still owe the money!
 
the thing is tho there is no contact details at all for the phoenix company that own the debt. i have written to fredrickson and there supervisor contacted me and said they cannot write letters they are all computer generated. and as for the request for the details there is somehting on that link about that.
 
First of all, look the company up on companies house - if it has a name, it should have a company number.

After obtaining their address, I recommend you right to them with a cease and desist letter.

Obviously amend as appropriate. - It may just give you some ideas, who knows :eek:

I refer to previous correspondence.

I do not feel that you are acting reasonably in this matter.

I have asked you to contact me directly by mail, and not by phone. The reason for this is that I do not want anybody else in my household to know of my financial status. I believe that it is within my rights to ask for this in accordance with the Administration of Justice Act 1970 s40 (1)

I am also asking that you provide evidence to substantiate your claim against me, as I am yet to be shown that my alleged debt is with your company. I feel that I have done all that I can to assist you thus far. Unless you can provide evidence to substantiate your claim against me I shall be unable to help you further in this matter.

This alleged debt therefore remains disputed by me. Save for supplying the evidence referred to above I must ask you to cease and desist correspondence with me.

Other than as described above, any further correspondence from you or any other party in relation to this matter may result in a complaint to the authorities under the Protection From Harassment Act 1997.

In order to bring this matter to a speedy conclusion, and for the avoidance of doubt, I have reiterated my requests below.

- Please make any further communication with me via mail only.
- Please provide me with a copy of the alleged credit agreement.
- Please provide me with all company details regarding Phoenix Ltd

If it is found that Phoenix Ltd does not own my debt, and does not reply within 14 days of this letter to bring this matter to a close, then a complaint will be made to the authorities with regard to s2 The Fraud Act 2006 (Obtaining money by false representation).

mate thats sweet ! they already in breach of it so im going to send that to them and also report them to the FSO :D they will be inspected and if they cant provide me with the details then they get nothing lol
 
Also, just on a side note, if FredRickson get in touch with you again, notify them that the debt is in dispute and ask them to refer it back to Phoenix - any further requests for the money will be reported as harrasment.

Or write to them.

This alleged debt is in dispute. I have written to your principal on a number of occasions and they have failed to substantiate their claim.

wohoo best of luck mate (y) i get seriously ragged off by these companies that seem to believe that the rules dont apply to them. I had to take DHL to a tribunal because a week before they lost the business contract they sacked me, i went to the agancy they were using at the time and signed up and luckily monday morning they contacted me to work there. when i was there i discovered they were losing the contract that friday and all had to be out so in i went and they settled outside the hearing :D
