Difficult with out knowing the whole story, sounds like a very expensive job even if parts turn up, which does seem unlikely any time soon.
Are they saying you are going to be presented with a bill of around £700, just to tell you the engine is fu**ed?:(
£700 plus vat. Then the added expense of puting sump back on. I have emails and text messages stating enginge checked, mechanically it's ok, waiting for auto electrician to check harnesses? Then on morning of 18th the engine was started/ turned over a few times as my tracker shows voltage going upto 14.3v then I got email on 19th saying engine seized. Think I may have to look at the legal route as £20k for recon engine 3 years after replacing the engine is going to hurt!

Your legal representative can employ a independent engineer to give a report if it has to go that far.
It seems like two separate issues, one how good the replacement engine was and was the cause of it's original failure sorted at the time, then has anything been done by you as the owner/driver that may have caused it to fail.
Then the second part is the quality of diagnosis of the engine after it's failure.
Was the engine replacement done by a different garage and what sort of warranty on that engine?
Has the vehicle had all regular services since then done by a professional garage etc.
These are all questions that would be asked.

Original engine failed after 24k miles on moho, in Aug 2021, repair consisted of recon engine, injectors and turbo. All supplied and fitted by Fiat. Then in November 2023 the turbo failed due to internal damage of impellor blades, @10k miles after being fitted. New turbo supplied and fitted by Fiat garage. Now May 2025 engine seized again. Last engine service done Feb 2025 by independant garage. I've been using the independant garage for about 10 years.

Doesn't give you much confidence of those later 2.3 engines when compared with the older 2.8 Sofim engines, some good for around 500k miles.
I have nothing against using an independent garage especially if they have given you good service over many years, in fact I was a small independent with regular customers for around 40 years, however the big Dealers will try to run them down.

That was part of the reply I got from Fiat UK, my van wasn't showing as being regularly serviced on their system, I told them I had it serviced every year by indepenant garage and had invoices to prove it.

A friend of mine bought a new Range Rover, even though he ran his own garage he had to have the vehicle serviced at the Dealers to comply with the warranty at expensive labour and parts costs. One time on collecting his vehicle from their Dealership 20 odd miles away, halfway home the brakes seized up on one side rear after their "Land Rover Trained Specialist Mechanics" had serviced it, he rang them and they collected it and provided a car for him to use, a few days later he drove up to collect the "repaired" vehicle, got halfway home and the other side rear brake seized. If he had serviced it himself it would have been done correctly for just the trade price of the parts and the vehicle would not have let him down.
It doesn't matter how big or small the Dealership or garage is, it is down to the quality of people actually doing the job!
A good friend of mine whose vehicles I had serviced since 1976 bought new Toyota cars for him and his family as I was retiring and he included a servicing contract as well. He ended up with costs nearly four times mine and when Mot was due their service department was finding unnecessary work on the vehicle, which when I inspected the car for him they agreed it didn't need doing for the MOT, also they advised he had the air con radiator be replaced, he said fine it is still under warranty, suddenly they decided it would be OK to leave it!!!

In Australia we do not have to use the dealer.

Under Australian law, a vehicle manufacturer can’t compel you to have your car serviced through and authorised dealership. This means you can take it to a suitably qualified, registered mechanic of your choice – including your local garage, a national chain or mobile mechanic – as long as the service is carried out in accordance with the manufacturer’s specifications.

As far as I’m aware and research deeply under UK consumer law there is no obligation to use a franchised dealer providing the servicing is done within manufacturers time scales, uses OEM parts and garage is VAT registered.

True , but the Dealers will always try to infer that any issue is caused by non Dealer work.:(

Looking at having engine either swapped or rebuilt from ground up. I've been looking at new/ recon turbos and injectors. Are there manufactures that are better than others of releiabilty etc. Thanks
I would go by what your mechanic recommends if he is fitting the stuff he will know what is best locally.:)
