I may be mistaken, but as far as I'm aware they can't add new regulations about emissions to the test for cars made before the regulations came in , I don't know exactly where it is in the manual, but for me personally if a car came in with a cone filter or mushroom filter and it appeared to be correctly fitted, bearing in mind that an MOT test is primarily a visual test and you can only check unsprung mass for they're rigity i.e., bushes, ball joints, see if they're is any looseness regarding the wheels and such, if they're was a filter it wouldn't have to be fitted correctly it would only have to appear to be fitted correctly and pass the emissions test to pass an MOT

It's not a change in the regulations as far as I'm aware, rather a new check to ensure the regulations are being complied with, same as the HID headlight retrofit check.
I agree it's down to the tester, but the visual inspection is for "Emissions control equipment fitted by the manufacturer missing, obviously modified or obviously defective". What is not 100% clear is if the airbox and filter are considered part of the emissions control equipment. The argument that they are is supported by the fact that an intake leak is a failure under the same section and breathers (which are emissions control, remember fumes, oil or fuel leaks are emissions) often connect to the airbox. Bizzarely if modifications to the breathers are covered then fitting a breather catch tank (which reduces emissions if disposed of properly) would be a fail.

Again might be mistaken, but i think when they say emissions the mean a cat or dog, someone who is very pernickity may fail it on this, but I certainly havent seen anyone even check this sort or stuff

That is not correct, it will apply to all cars that need a catalyst test. It's similar to the change in 2012 that said if a CAT was fitted by the OEM then it had to still be fitted even if it was not required to pass the emissions rules in place when the car was made or the MOT test. Caught a lot of older car owners that had the CAT removed years previously without issues and suddenly had to have one to pass. That also added checks for airbag lights, steering locks and a bunch of other stuff. A member here is having trouble because the electronic steering lock on his Croma is disabled. It had it's first MOT well before the 2012 change. As a side note it should not fail anyway as the Croma has also got an electronic immobiliser. Garage won't accept this so it's gone to the DVSA who say it should have passed.
Sorry if this come over as a bit pedantic, but interpreting technical rules (in aviation) is part of my day job. If I'm wrong I'll accept that but like to see evidence.
