Hi all,
Pretty annoyed today - I was parked in a disc car park with my disc displayed. Went to dentist and was only gone for 10 minutes. I return to the car and my first Fixed Penalty Notice for parking in a permit bay without displaying a permit!
If I had parked wrongly then fair enough, it would have been my fault however the space I was parked in has no sign saying its a permit bay. See picture. The outer bay lines are a bit broken up and the writing on the floor appears to be markings for resurfacing. FYI the car was parked in the bay in the middle of the picture, not where it is in the picture.
Im thinking of challenging it, do you think I'd get it revoked?

im fairly sure if the lines are not one complete strip (ie no breaks in them) then you have a case. I rememebr there was a story about an old guy who kept parking on a yellow line and was receiving lots of parking tickets, when he went to court he pointed out there was no 'T' bar on the end of the yellow line and they had to let him off!! Give it a go, can't hurt! I wouldnt pay it
 
If there isn't a sign anywhere to be seen saying that it's "permit holders only", challenge it! Take plenty of photos aswell!

It's a parking bay so why shouldn't you be able to park there!!??!!

I would definitely challenge that. As suggested, take pics with date on them if possible

I don't have a camera that puts the date on photos but have been back to get more photos and there is definatley nothing saying the bay I was in is a permit bay. Im certainly going to challenge the ticket and im thinking about writing a letter to both ParkWise and the Rossendale Free Press because they are becoming a menace.
It appears to me they just slap notices on and hope we don't question them and just pay.

I'd go back and try and scrape the rest of the white lines off then take the picture. At least then there's grounds for a definate case. LOL.
 
I've just shown the picture to some of our legal bods here and provided there is no clear indication of it being a permit only bay, they all seem to think you will be able to challenge this successfully :)

Yup write and you should get let off, as there is no sign, i had a similar thing in glasgow and got off, there was no sign.
 
Rob - I knocked over an old lady and took pictures, could you show that to the legal bods and see if i can get away with it?
 
I was just wondering abou the location; it looks vaguely familiar but probably isn't?!
 
It is Waterfoot in Rossendale, Lancashire in the car park near the library looking towards the side of Tim's Chip Stop.
Is that where you were thinking it was?

There's a sign with the parking symbol just above the landrover windscreen in the 2nd picture (to the left of the Corsa), what does it say on that?

I read all that sign, does not mention any permits required for specific bays apart from the 2 disabled bays which have large yellow wheelchair symbols painted in them. Rest of the sign explains the disc parking - 2 hours, what times in operation, etc.

Having read all the info on this thread and seen all the pics. it seems to me that you are in the clear. The ticket was issued because you had not got a permit for the bay you were parked in. there is nothing to say that it is a reserved bay. you were legally parked as you had purchased a parking disc. No worries mate. Do nothing, Go to court and claim expenses and costs incurred
