I have had a "S" reg Seicento since December on HP and the garage has had it longer than me. 3 Weeks in December for a gear box squeel and now for the last two weeks, it is back at the same garage with the same problem. Any advise please? Is my little car going to die on me soon?

Reject the car?

I'd suggest the clutch release bearing may have failed, may need a full new clutch. Just a guess mind, difficult to diagnose via t'internet sometimes!

Under the sales and goods act, if the item is unfit for what it is for (in this case to drive around) you can reject the car with full refund or replacement car with the same spec / condition as the first one you have brought

Check the act and read it though before jumping to the dealers

The sale of goods act was amended a wee while ago so that its no longer 'fit for the purpose' its now 'acceptable quality'. I would suggest that as they have had a chance to repair and failed that the bounds of 'acceptable quality' have been breached.

Write to the garage, keeping a copy, send it recorded delivery, rejecting the car and requesting that you will collect the money on a certain day at a certain time, obviously a time that suits you, and that they are normally open.

If they fail to respond then off to the CAB with your evidence and the small claims court for a form to start a small claims action.

Its still under warrenty, right?

I know you want to have your car, but its getting fixed for free! This is at the dealers expense, if you take it back, it may be a while before you can get another car.
