I bought a car from a car sale place today, a punto 1.2

after about 30 mile it started making a grinding noise in 1st and 2nd gear

i have been told that the gear box is probly on its way out.

ive looked at my invoice though and it says sold as spares.

i didnt see that, i should of read it.

anyway the guy who sold it me said there was nothing wrong with it, and the advert on autotrader said drives well, in good condition ect.. this has since been removed.

is there anything i can do? should a ask them to fix it or will they not because it says sold as spares??
 
I would reject it in writing (quickly), and report it to trading standards if he doesn't give your money back. If you kept a copy of the advert that will help - maybe AutoTrader can help if you didn't as they really don't like anything dodgy with their traders.

I don't think that using that phrase has a firm legal standing looking at some of the discussion threads, and it may be that you can take him to the small claims court if it comes to it - if you have legal expenses cover with your insurance give them a ring as they might be able to give you some free advice.

Of course, take the car back & may I suggest taking along a large mate/relation. Tell them you are not happy with the car, & if things don't get sorted out, you will be be taking things further.
 
the mate id take wouldnt help the situation lol, so do i have the right to ask for a repair or refund even though it says sold as spares?
 
I rang the garage today, told them the problem..

they told me it had no warrenty being a part ax car (they took it as a part ex then sold it to me)

he told me to take it back monday and he would swap it with something at a similar price.

BUt i like this can and want to keep it
 
You might be better cutting your losses on this one you might like it but it already has problems the dealer might have known about and figured that he would get away a bit longer before they reard there head.

You can only go back and see, he's gonna have to scrap it or fix it if he wants to sell or take a big hit getting rid at auction so he might do a deal with you, then again he might offer a nicer car, as fingers says go see what they want to do.
 
I know you like it but trust me, no matter how nice or how great it is, something better will always turn up, get a refund and take it as a lucky learning experience, i got done like this with the old "trade sale" sneakily written on the bill of sale, but i was not as lucky, fell for the old "it miss fires cos it wants plugs" con. :(
