What's the deal, my wife got flashed at 5am this morning road conditions good. Will she get a fixed penalty or a summons? Or will she get a ban? If she gets a ban then she will be screwed as we live 50miles away from our parents and with 3 children under 5 she won't be able to go anywhere.

She knows she has been stupid. But I can't find much upnto date info ok this subject.

a speeding ticket will not normally lead to a ban, penalty points may go on the licence as well as the fine. I think there is a time limit too that you must be notified by post of the intention to prosecute.Never happened to me so i don't know the exact details
 
how fast was she goin and what was the limit? I only eva had 1 but was about 7years ago n i was doin 42 in a 30 and i got 3 points and 60pound fine.don't think you she wil get banned unless she goin ova 100
 
will defo be fine n points then.. But i have been flashed a couple of times and heard nothin so fingers crossed mate. Keep us posted
 
the official rule is 30 over the limit is a ban,
so: 60 in a 30 70 in a 40 80 in a 50
90 in a 60 and 100 in a 70
so at the most ull prob just get a fine and 3 points,but most cams dnt even have film in them.fingers crossed

The camera has to flash twice to work at all, of course
- but I'm guessing at the speeds mentioned, it did so
 
There is a potential loophole (could be a modern day myth, but unless you're in the position you never find out!) which could allow you to only pay the fine and not have the license affected.

the above is what my driving instructor told me,must of changed since i passed my test(2 1/2 yrs ago)

30 mph In excess of 51 mph
40 mph In excess of 66 mph
50 mph In excess of 75 mph
60 mph In excess of 85 mph
70 mph In excess of 100 mph

Although the Police attempt to resolve most offences by way of a Fixed Penalty Notice, at excessive speeds, a Court appearance is inevitable. For speeds in excess of 100 mph (or more than 30 miles above the relevant limit) the punishment starts at disqualification as opposed to penalty points. However, the decision is at the discretion of the Court and in certain circumstances, a disqualification can be avoided.

and we all know how easy it is to do 75+ on a 50 dual carrageway lol
 
I onyl asked as I got pulled for doing 120 in a 70 (not big or clever) and was told by the officer that they have the discretion on any case to resolve with a fixed penalty or court hearing but due to the excessive speed in this case they weren't prepared to fixed penalty it.
Once it went to court it was purely down to the magistrates what punishment to give. I was lucky and got 5 points but no ban.
In answer to the original post, they legally have to issue you with a NIP (notice of intended prosecution) within 14 days of the offence. Although allow a few days extra for the postal service (sepecially at this time of year) before starting to breathe too easily.

Thanks chaps... i have had to pull out of my marea saloon deal as i need the money for the fine (as i am unsure what it will be yet)

yeah,police have discretion which is why a friendly attitude always helps lol
 
Lucky not to get an instant ban at 120mph..!

I got caught (5 years ago!) doing 57mph in a 30mph zone... I got 0 points, £0 court fees but a 30 day ban. :( It would have been worse but I'd just quit my job and sold the car, and claimed to be in search of a driving job, so a long ban would be bad, etc. etc. :LOL:
