If you expect the buyer to send the item back then you should also refund that cost as well. The buyer shouldn't be out of pocket for 'faulty' goods.

It's a difficult situation to be in. You don't want to send a refund in case he's pulling a fast one & there's nothing wrong with the set however, it might be a case of buyer's remorse & he's making up the fault to get the refund & if you insist it has to come back, you may find he's put the fault there just to get the refund.

If you only refund original costs, he may then report you to ebay as a non-performing seller.

By coninsodence, I've just read this that they've sent;

hello i can tell from your feedback that you a good ebayer but i dont feel happy havin to pay for the postage to send back the faulty item and the payment by cheque as i dont have a bank account did you check the item before you sent it out

What do people think about the no bank account thing. I don't really want to have to bother getting a Postal Order. And what cost do they charge :confused:

Id just take a negative feedback but thats cause im an arse.

if i have had to send an item back it has always been less postage. i know a buyer should not be out of pocket but neither should a seller!

this sound's like he has got no reception and wants his money back, if the item is working via dvd the item is imo okay, could you not offer a discount as a gesture of good will? For remote and plug issue, No doubt he will just neg you anyway

This is what I'm thinking. If I'm going to get -ve then I may as well get it and still keep the money, but not sure if I could morally do that.

TBH I does state in my T&C's that all electrical items are sold as untested unless stated, and that return's would only evey be minus P+P cost's, so I'm already helping this person.

Is there anything they can legally do or action they could take against me :confused:

No legal action would likely follow, no one in the right mind would persue £20 in the small claims court which costs more to enter into than what would be refunded. The time involved would be huge, and he would have to come to you if it ever made it to court.

Take the neg, and move on - respond to the neg with "Buyer complains as he's in a low signal area" - or such like.

Item wasn't 'sold as seen' because it is being sold in an online auction & buyer can't examine it before purchase so buyer has some rights through DSRs
Box clearly says digital remote control - and the picture of the contents is vague enough to lead someone into believing it has a remote (and you expect a telly to have a remote).
I have seen threads on ebay where buyers have pursued sellers for just a few quid (on principle), never mind £27 because they are sure they are in the right - if they win the case, they get the £27 PLUS £30-odd court cost PLUS their expenses for getting to the court, as a seller, that could prove very expensive.
As was said earlier, refund in full & mark it down to experience or ask buyer to return for checking.
I'd just give the guy his £27, learn from the mistakes mentioned here & move on
 
if i was you i wouldnt worry about 1 neg
think the general decent buyers do know there are a lottttttttttt of idiots on the bay at present any one above 90 % is generally a decent seller

ignore him they might go away or tell him your going on holiday for a month
just be as arwkard as hes being

pps if that works ill buy if its 12 v lol

Sadly, that is not the case, there are a lot of sellers out there who still use feedback blackmail to stop people giving a neg & many people just love that 100% so much they allow the idiot seller to do what they want as long as they can hold onto that 100%
