Hey all, i sold the malaguti last month (17/3/09)

got a fine through the same day saying i didn't notify them i'd 'disposed' of it to someone else.

i thought him sending off a logbook in his name was notifying them?

instead she said i should have wrote them a letter first. WTF?

they want £35 off me for it, hardley an inconvenience at their end, it's just a stupid little regulation to swizz money out of you.

any ideas what i could say to them?

i have £0 at the minuite (n)
 
It's still your responsibility to notify the DVLA in writting that you've passed it on.

When I sold my punto the guy that bought it took the whole logbook :bang: so I wrote a letter to the DVLA simply saying

"I' am no longer the owner of M** *** Fiat Punto 55s (Horrid bluey green in colour) as I have sold it to Mr **** from London on DATE"

They sent a letter back saying thanks we've noted you are no longer the legal keeper of this vehicle.
 
They'll just say it's your responsibility to make sure it gets there, and that you are legeally required to notify them not the new keeper.

TBF I think the system sucks, but I really do think in this case unless your lucky on the phone you'll have to ride the wave of DVLA taking you for your money!

i'll give it a shot, i hate the DVLA! im going to pull the tax of the mondeo next month i'm away all month but 5 days.
 
Exactly same happened to me when i p/x the mondeo, i did the same didnt notify and had to send a letter in etc etc because i gave logbook to seller and he didnt send it in

They will say time has passed and theyve heard nothing, they will demand post office reference numbers, day you posted it etc etc

they will increase the fine if you start playing dumb as well or it doesnt get paid

just get it over with and pay it as you havent a leg to stand on in reality

All i did was write a letter saying 'i am no longer owner and i sold it to this guy on whatever date it was and gave them the sellers number to contact if any problems. I sent it recorded delivery as well. They wrote back acknolwedging my letter and struck my off the record of being the current owner but still had to pay fine

Its not a swizz, id have the fine even more if i was in charge of DVLA, stop people having so much disregard for and misusing the V5

what i was tryin to get at was, him sending the logbook off and me receiving the letter telling me he's sent for it is kinda telling the DVLA i've sold the vehicle.

They are notifying you to say someone has applied for the logbook - to give you a chance to stop fraud etc (someone sending off for a log book that isn't for a car they own).

As you didn't stop it - they must therefore assume he's getting the logbook on your behalf or for him but you to remain the legal keeper.

Until you either send off the logbook saying it's sold or you write to them to tell them it's sold you are allways going to be the legal keeper and thus face the fines / greif.

Sucks but that's the system!

yeah, surely me not stopping him getting it shows them i'm alright with it, thus showing them i've sold it.

no point even arguing to them though, i've pretty much lost interest in everything today
 
Know how you feel Alex as the logbook went missing when I sold the Slightly-Pink-Chink (the DVLA seemed to hate the paperwork for that car - I bought it logbook-less weeks before because it had gone walkies in the last sale) and I got a letter when the next owner re-applied for the logbook and never thought anything further of it, but somehow I guess I was lucky and didn't get fined. Don't blame you for trusting him to send it off to be honest!

i'm not paying the fine, don't care what happens TBH, they can take me to court, i'll have nothing for them to take off me, mondeos going, so is my bike, nothing else is in my name for 'em to take, plus it's not my house lol

I didn't, it was the Chink I used to have years ago ;) Appeal to their better nature, you never know your luck :)
