I beleive this proves that it is not the brake switch (correct me if I am wrong), and the fact that I have indicators and rear lights proves that it is not a light unit earth fault.
I changed both bulbs and ran out of time so did not get a chance for further checks.
Is the cuircuit fused? if so does anybody know where the fusebox is on a 2000 JTD? is there a relay as well in this circuit?

Under the Drivers side lift up glove box. Lift up the flap, and the tray shoud be removable with plastic twists. Under is the fuses etc.
 
only one fuse does all three lights, 15 amp fuse [ F 1 ]bottom row third one in. check lives and earths at bulb holder,then check the larger plugs ,pluged into to top of the fuse box.

proved live and earth at light unit connector on each side, fault was at light unit connections (bad contact) with the bulb holder.

Brake lights are now working properly.
