Well i was in my car in a carpark, your usually driving in this case, otherwise your shopping! I was actually reversing away from him as such! So he could be nothing other than completely to blame? Unless your claiming i've got a Herbie and can lock all 4 wheels sideways?

I was reversing away from him into a space, he was reversing out of a space, onto my side of the road and into the SIDE of me! I'll argue with the insurance firm until they right it off as their loss if they even so much as think of trying a 50/50 on me!

I do the same - especially if in the Ulysse - the tailgate swings upwards and outwards, so if I reverse in, then isn't a hope of opening the thing unless the space behind is empty, and at this stage I have scratched all the cars next to me getting the trolley down the side of the car, because all the 'child places' are taken up by chavs

With no independent witnesses or hard evidence it's an irritating fact that most insurance companies will settle for a 50:50 The other driver will almost certainly concoct a convincing (fictional) story.

I you feel really strongly about it then you do have the option of suing the other driver for damage caused to your car, and provided you win, then your insurance company would be forced to hold you blameless. It could be risky though, especially if the other driver has legal assistance.

I have legal assistance on my policy! So i'll fight it all the way! Taking car into coachworks tomorrow to get a quote!
