Well I ordered some parts for my stilo last week, all came and was fine, Inside the box was my new grill and sports air filter,

However on the paper with the order it said "air filter Ford puma/fiesta"
This is obviously wrong.

I emailled Fk to try and rectify this issue,
They tried to tell me that I had odered the wrong part.
and asked if I could post back the filter. (this is obviously a stupid idea as it would cost me more than I paid for the filter in postage) I showed them that I did not via a forwarded order conformation email that they sent to me.

So they still said I ordered the wrong part. and asked for photos and screenshots of the web page.

After doing this they then asked for a screenshot of the german web page so they could compare.

It turns out the same part number on the uk website is a stilo filter (£8.59), the filter on the german website is a fiesta/puma filter (£3,39).
So they charge you more for the same filter.

Also they are asking me if I could sell the filter and then they would not have to refund the cost. (what a stupid idea I do not want to have to sell something because of someone else's cockups.

So I have given them everything they asked for and they have done no work whatsoever to rectify this and after me requesting a refund several times they will still not refund me. I will let you all know how it goes but at the moment FK are a brand I will NOT be buying from again.

Also,, where does it belong then? I wanted to put it so that most people would be able to read it.
 
This should be in leisure lounge, would get more coverage.

but when i've had these issues, the companies refuse to refund untill the product has been returned. but they offer to cover postage.

You absolutely sure that the filters for the Puma/Fiesta dont fit your stilo?

Ive had parts delivered that say a different car on them but fit because they are generic parts.

In which case dont see an issue. (if it fits) *(except the cost)

Nope no offer to pay postage costs at all.

and Im sure it doesnt fit lol I can upload photos if you want me to but they are fatter and shorter than the stilo filters

Their cock up yes, but you can't expect them to refund your money without returning the product. They may as well just give out free stock to whoever asks for it.

Maybe a phone call to their sales team to explain the situation and ask if you return the product, can they refund you the postage costs and send you the right one? Ask nicely and thou shalt get.
 
I paid via paypal and have now raised a refund request through there,
Fk said on thursday they would see what they could do, so far nothing back,
and Bushboy I agree but they have not offered to pay the return postage at all. and for the cost of the return postage there is no point in them getting the filter back as they only retail it for £3.50,
my issue with phoning them is that its a german number and I only have my mobile no landline :/
 
Both SOGA (Sale of Goods Act) and Distance Selling Directives apply here.

Basically, the goods don't match the description (i.e. different item), so you are entitled to return it to them, and they need to cover your return shipping costs.

IIRC, under DSD, if a retailer sends you something you didn't order, it is effectively a 'gift' and you can do whatever you please with it. With that said, the intention of this point is for 'unsolicited goods', so it's only relevant if they have INTENTIONALLY sent you the wrong thing.

Regardless, PayPal will give you a refund. If they don't, call your bank or card issuer and they will do it.

I have quoted them most of the information on that web page and we shall see what the send back next, I also informed them that they do not have the right to remove customers legal rights :) and failing this I will escalate it on paypal, and let you know how it goes

Is the response I got from FK, is it just me or is this technically breaking the law as on the website donaldsonlynch linked to it says it is illegal to mis lead a customer.

"It is also against the law to mislead consumers about their legal rights - this could lead to a criminal prosecution under the Consumer Protection from Unfair Trading Regulations 2008."

I think the issue you have here is that SOGA is U.K. legislation, and they perhaps have completely different consumer rights in Germany. However, the Distance Selling Regulations is EU wide legislation, so they most certainly do have to abide by that.

Regardless of that though, if they are trading in another EU country, they have to abide by that countrys laws, as well as their own.

It sounds a lot to me like they did indeed intentionally send you the wrong item... I'd treat it as unsolicited goods... so, consider it a gift, dispose of it as you like... and tell them you expect them to send the correct item.

If they don't, and I suspect they won't, open a PayPal case for goods 'not received or significantly not as described', and get yourself a refund.

Funny you should say that dave, they asked me to close it on paypal before they refunded me the money, I told them no and that I couldnt until after they had refunded me,
I take it you meant that rather than closing the thread? lol,
 
Just like to finally say that FK did send me back the refund via paypal,
Although I sense that if I had not used paypal I wouldnt be getting my money back,,
Ill let that be a lesson to me anyway :)
