:confused: Let me get this right... you were done for using a phone while driving, that you claim didnt exist?

You had a cast iron defence, the phone company records would show if you were using a phone at the time, day & date.... even the rough location....

I'm confused.... help me understand...

Could have been done for 'using' the phone as in not calling someone, looking at a map on it, taking photos, or playing a game :rolleyes:

:confused: But the phone didnt exist... I'm saying that his defence would be to ask the phone company to prove it didnt exist... or at least prove it was not "live & active"...

Depends how it didn't 'exist', I just presumed he wasn't actually using the phone. If he had no phone on him at all then it's a different story.

But like I said, the police could have said he was doing something on the phone that the phone company didn't know about, such as playing a game. Which wouldn't be using the network and the phone company's proof wouldn't have been relevant.
 
I got pulled over by a copper when I was in my early 20's. Was driving some mates home and the police woman tailed me back to their house. When we got there the conversation went like this:
Policewomen - "Is that your car"
Me - "Yes"
Me - "Would you like to see my documents"
Policewoman - "No"

And thus she drove off. I mean WHAT WAS THE POINT? Im hardly going to say "no its not my car, I just nicked it from round the back of the chinese" Fair enough pull me over and check my ID and docs, I could understand that!

I also got stopped by the police when I was fourteen. Was stood outside a school waiting for my mate at about 8pm. Police came over and asked me what I was doing. I said waiting for my mate. They asked if I was thinking of breaking in to the school as I was loitering. Now this would seem a fair question but due to the fact I had a broken leg in cast up to my nether regions and crutches it was not likely I was going to make a quick get-a-way!

Ah sorry I didnt intend to cause a debate lol

No my phone was in the boot (in my work bag) but due to the policemans mistake, he simply said "well you were using something and it looked like you were texting".

I had call records etc, though the solicitor said they would back me into a corner and say "you must not have sent the text hence why it is not on record"

I mean when he pulled me he initialy said i was tapping something on my chest, then when i got the letter through, he said I was doing something near my stereo that looked like texting!

I didnt want to start a debate was just pointing out I know the feeling of being pulled for nothing lol ;)

Its **** but some things just have to be taken on the chin

I just edited the post,

It was in my work bag...ironically, so i didnt have the urge to use it whilst driving.

Obviously not good enough eh.

Even worse, I have full hands free via bluetooth aswell which was enabled...obviously he just didnt like me and couldnt accept the fact he was wrong

Not a sob story but be careful for these sort of things, due to it being my first time being pulled i didnt have the confidence to say...hang on, you really are wrong here.

my cousin got done for drink driving but he didn't drink drive, he drove to the pub for his mates birthday wasn't drinking coz he was working the next day, changed his mind so booked a taxi and had a drink or two, came out in time for his taxi remembered he had valuables in the car so opened the passenger side door lent in and got what he wanted police man came up behind him asked if he had been drinking, my cousin said yes and the police man arrested him on the spot for drink driving when he wasn't even in the car, the taxi driver turned up and vouched for him but the police man wouldn't hear any of it
 
Don't understand why you'd be tempted to use it if you've got full bluetooth etc in your car already. And putting it in your boot, despite the bluetooth fact, makes this whole situation stink. Like a sewer. In summer. In Africa.

Yes they can do you with intent to drive under the influence. 'I was just getting something' won't cut it, no matter how true it is. (n)

You sound like the court...

...I walk out of work put the bag straight in the boot. If somebody sends me a text it is tempting to check it, whether driving, in a meeting, at the gym etc.

By putting it in the boot, the temptation is eliminated and hence stay on the right side of the law.

I dont understand why its causing debate?

It is what it is.
 
it was obvious he wasn't intending to drive though because he had booked a taxi hours ago and the taxi driver showed up as well but meh nothing you can do
if that was me, i'd properly flip. if they were trying to arrest me for something i hadn't done and they wouldn't believe they'd literally have to hold me down :mad:

EDIT: i don't mean being violent or anything but i certainly wouldnt just jump into their car, its crazy how they can do stuff like this
