the police/ insurance company's look for anyway they can to get a conviction/ apportion blame Insurance companies like Photographs taken at the scene and of damage, and it would certainly go well with the written description of events providing the accident wasn't your fault if thats the case I'd swallow the SD card ;)

as for the police they tend not to like anyones CCTV until it can help them...

Take our old neighbor but 2 doors down who had problems with yobs kicking his metal up and over garage door in along with graffiti he put a pin hole camera which well hidden between the wall and the corrugated asbestos sheet caught them in the act of causing criminal damage by kicking his door and spray painting his garage door,

He contacted the police who told him they couldn't use it as there were no signs up warning of cctv and it wasn't time and date stamped and it was illegal as it wasn't overlooking his property (it was looking into the 10 foot)

...... Then 2 weeks later the paper shop gets done over and the till is dumped right outside his garage. Next thing coppers are playing the all nice and community spirited card at his front door as they want to see his video you can guess what he told them to do

the way im planning on doing mine (got the DVR through) is that this unit take clips in 10 second segments then a second pause then it records again

(sods law dictates it would probably be on its seconds pause just as some twonk pulls out but at least it would show my position in the road immediately before the accident and the immediate aftermath if it doesn't survive the impact being solid state in a metal box chances are i wont have so wont be too bothered)

but it records immediately from power up so once tagged into the back of the fag lighter (pulls less than 0.5A) as soon as the key is turned it will start to record its so small im planning on mounting it on sticky back Velcro under the drivers seat once the 2GB card is full it starts recording over the first recording (first in first out style) so it will be basically fit and forget i can either use the DVR itself plugged into a TV or a memory card reader for play back and it time and date stamps each file....

im still tossing up between what camera to use i already have a small CCD Black and white PCB and lens that im going to test the theory out on when i get chance but ideally want one of these

or

this mounted behind the rear view mirror

that way it will be so subtle no one unless you look really closely will know its there so no need to remove it every time i leave the car

EDIT 2x some quick pictures of the DVR

2p coin to give an idea of size as you can see its small...
