it will be engaged and then will fall back to the off position without any help, is there a rachety type thing I can replace or is it the whole handle assy

Most probably wear in the ratchet, but have a check to see that nothing's sticking in there - like the spring.

If you need to change the handbrake lever, it just bolts to the floor with 4xM8 bolts (13mm socket job). Oh, and it's connected to the handbrake cable as well, you'd need to undo that too
