To be fair - I got a decent payout for my car at the time. I got book price, and I'd paid less than that for it.
You can never expect insurance to pay more than book - so if you have paid over the odds for a car because it's in superb condition or whatever, then you need to agree the value with the insurers on the policy. Same applies to a modded car, if you want the mods covered properly you need the appropriate policy.

However, there is a knack to doing a deal and getting a good payout..... for starters, always get opinions to what the car would be worth locally (Cars are expensive in Norfolk, for example and cheaper in the Midlands).
 
My sister had a crash like yours. The person that went into the back of her said she shouldn't of stopped, even though there was a car coming. My sisters car was a write off, and looking at it you would not of thought it was, only had a small dent on the back.

When the insurance company came to view the damage, they didnt even ask for the keys/to move it out of the driveway. Just took about 2 minute look at the back and declared it a write off. So these can be a pain in the arse if you get an idiot who doesn't care.

In the end my sister did get compensation for whip lash, but their insurance only paid what the car was "worth". She got £400 for a saxo furio. She paid £1,000 for it two month before.

If they write my car off, it's still my possession, and I don't have to hand it over, do I? They'll pull the keys out of my cold dead hands! :devil:

One final thing: Can I get the car repaired independently? I don't really want to take my car to a random "approved specialist" .... they will probably do it on the cheap!

Yep, you can take it to a body shop of your choice, although insurance companies don't then have to provide a courtesy car if it states this in policy.

But any good body shop will give you one for duration of the repairs (y)

I still don't think the woman at the insurance company I dealt with could work out how I made the insurance company she worked of return a CAT-A write off of ours from their depot in Essex back to us in Lowestoft :devil: :)

Just an afterthought, the Tax Disc (Vehicle Excise Disc/Road Fund Licence) is important, because if it's out of date or snide, why? Does he not have tax because he hasn't got any insurance? If he doesn't have insurance is that because he doesn't have a licence.

As you walk all round the car assessing the damage/road/weather conditions etc., have a sneaky look at the disc. If it's dodgy, tell the other driver you are going to phone your Dad to get him to bring down your docs/tow you home put your dinner under the grill, or whatever you like and phone the Cops.

Just tell them you have been hit by another car and you have reason to believe he has no insurance. If necessary you could also say you think you could smell alcohol or canabis.

If it turns out he doesn't have insurance you have the satisfaction of seeing him get nicked. If you only have 3rd Party or TPFT, the Motor Insurers' Bureau should be able to offer you some form of compensation.

If he doesn't have Road Tax, the DVLA will fine him more than if he'd killed you and your entire family.

I only ask as I called the police out to investigate when my cinq was broken into, they didn't turn up in the alloted 10am - 6pm time frame so at 8pm I went out - following day I had a ****ty note through the door saying they called in at 9pm and no-one was home, they then sent me a letter in the post warning me about wasting police time :bang:

The other party's "claims dept" said they would phone me this morning ... not a squeek from them :rolleyes:. I phoned their main insurance number, and thankfully I got through to a friendly worker, who gave me the DIRECT number for the "claims investigation team" :D. They weren't expecting my call, and wanted to know how I got their number :D. When this is all over I will publish the name of the insurer, AND the direct line to the claims dept! :devil:

I gave them my side of the story, and quoted the Highway Code very clearly to them! They haven't spoken to the guilty party yet!

The other party claimed all kinds of rubbish at the scene. "You had clear vision" .... yep, clear vision of a car that was already on the road, and I gave way to it! I've taken photos of the scene, which clearly show the other driver as a FOOL (y). The other party also said that I was at fault because I "didn't want to discuss it" ... what?! :D

I might have been tempted to phone the Duty Inspector for that relief and point out that a more agressive patrolling profile may be less of a waste of Police time than calling round 3 hours late and finding an empty house.

If the driver doesn't have Road Tax, unless it's only just expired, there's a very good chance the reason will be either a lack of Insurance or MOT. If it's the disc from another car then there's definitely something amiss. Remember, the Police themselves operate on the basis of a suspected or actual offence. You are reporting either an actual offence - No Road Fund Licence and a suspected offence - one of driving with no Insurance or MOT or licence.

Insurance companies have "Approved Body Shops" because they get a pre-negotiated labour rate and the body shop will often use Pattern parts, often made in China or similar. If your car is still under an anti-corrosion warranty, do you want to run the risk of non-galvanised body panels being fitted?

It really doesn't matter if you'd just nipped into the shop to buy 20 fags and a copy of "Big breasted teenage Swedish nympho virgin asassins", if she ran into you, it's down to her.

I posted elsewhere of a neighbour who was rear ended at a roundabout and
when the other party started to contest her claim from him by saying she pulled out into the lane he was in just before braking. When she wrote back and said she saw him in her rear view mirror looking to the right instead of at her car; the claim was quickly settled.
 
just stick to your guns! she was in the wrong hence the reason she is bein an @rsehole about it!!! i had an accident wen some stupid bugger didnt give way at a give way sign and wrote off my dads car id only been insured in for 4 days!!! she tried blaming it on me,saying i was driving to fast even tho it was 6am, my lights wer on and any normal person would have herd the engine coming a mile off, if not the music!!
my only words i spoke to her insurance wer ' if she thought i wer going to fast then why did she pull out!!! if she was a careful and safe driver she would have waited for me to pass and then pulled out!!!' also that i was on a car park just coming round a round about that was especialy designed to stop ppl goin to fast!
if u do develop an injury dont let the docs/solicotors take the ****
my 1st offer was £400 but i kept annoying them to send me to the docs! went for an mri scan and low and behold my offer jumped up to 4 grand!!! walked away with 5 and bought my beloved stilo with a a bit of the money :D

Do I have to wait for the other party's insurers to inspect the car (I suspect that I do :(). I'd rather get it out of the way ASAP!
