its completely flipped in the UK....cyclists can get away with anything, the motorist is always held accountable.

are they?
I have numerous friends who have been hit/been in incidents with cars.
no fault of theirs yet the car driver has never been convicted
I have a nice chunk missing from my leg that never fully heals from being hit by a car
 
We are very fragile and yet drive 2 tons heavy machines with 100km\h and find that mondaying. Still more people have died on the streets than in the last war in IRAQ, but we just read that in the paper, watch it in the news and carry on.. until it happens to someone of us. I saw some real videos of car accidents and they happen so quick you can't even see what's going on, just a second of distraction it all that it takes. If you hit another car driving in the opposite direction with just 50km\h no airbag or safety system can save you. A renault twingo hit my car in the rear, with I would suspect 20km\h (my gf was driving I wasn't in the car) and there wasn't much left of the renault, I can't imagine what would have happened if it was doing 60km/h. And don't get me wrong I've never had an accident, neither anyone I know.. (touching wood)
 
Mine is a good example. I was only doing around 50 and managed to brake hard until about 20 km/h. I want to think it was less than that because if I had 1 meter or so I would have stopped completely. I was SO AMAZED to see the damage at this low speed, incredible...~4000E worth.

So they're all tin cans you can only image what would happen if you are caught in an overtake doing 140 and crash into the truck coming at 100 km/h..

As I said above if you can prove it was the motorists fault you have a case against him. Generally speaking the penal code doesn't really state any real punishment for injuring in car crashes unless there is death or serious injury so and even so most of the convictions end on probation. If you did not file a complaint against him or did not stay in the hospital the minimum number of days (30 is in Romania) the prosecutors won't do anything about it. If that number of days is exceed the police send the file to court, but even then to go on with the trial you still need to file the complaint.

What Mehmet is saying only refers to insurance, you won't be able to repair your bike because you are not insured and the motorist cannot repair his car because there's an exception in the law and the mandatory insurance is good only between insurable goods so they can offset themselves if needed.

I am not fully aware of all the British laws in these regards but this is how I would interpret the situation.

another update:

They have bent the subframe back as much as they think it needs, they have managed to get the wishbone in now, gearbox is in, everything lined up (rattystilo's struts in (y) )...this morning drive-shaft is going in and they are going to assess the geometry of everything now its re-built to see if its straight and see what adjustments they can make...if they cant get it "perfect" ill take the car back and do the subframe myself, as the labour costs to change a subframe I imagine are quite massive (and id rather not add to my already mountainous repair bill)....but it should be ready today, and ill pick it up tomorrow before work (y)....then be VERY poor lol (n)
 
UPDATE:
and a good one (y)

Drove the car to work this morning, all repaired and done (now just got to worry about body work and the gashed wheel)

Cost was as follows:
All mechanical labour (including dismantling EVERYTHING and checking it all out, swap out gearbox (inlc. new seals nd nice oil), bending back subframe, fitting new struts, drivshaft, whishbone, drop link tie rod end, track rod end and tracking (apparently took them 2 hours just to align it all after they finished)) - £400
Wishbone nd droplinks were new - £30
Driveshaft - £10
Struts - £25 petrol money to ratty stilo (y)
Gearbox and tie rod/ track rod ends - £280
****ing rape of a recovery service - £140

TOTAL - £885

needless to say im quite poor ATM....

but at least its back on the road, I estimate another £150 worth of body work and wheel repair, but that can wait till end of the month

Glad ive got it back, it drives perfectly, no knocks, doesn't pull, wheels both central in arches, no camber that i can see...will be going to another place that i use just for tracking (been doing it for my dad for over 20 years) to see if its "straight" in their opinion when i get the chance...the dust cover on the front left wheel rubs going round tight bends, but i can forgive that oversight lol, only took 5 mins to fix ;). gna get a motorway test to see if its all ok at speed on the weekend....

glad its over, but not too happy it had to happen at all :(
 
My car is still being serviced from the 22nd of April, just to imagine how things work here :p

And it's all bodywork no realignments or gearbox. Just a bloody hood, a bumper, 2 headlights and a wing.. oh and a radiator.

Post some pictures if you can. Glad it's over so fast. :)
 
ill post some pics when i get home, still looks fooked cos they only did the running gear (ie got it working). still go to sort the body work (needs a new wing plus some paint, got a quote of £150 to re-paint side skirt nd wing, plus £20 to buy new wing) and £50 to fix the wheel....not too bad...but all these costs mounting :(

only reason mine was done so quick is cos it was done privately...ins. work over here takes ages as well...

yeah quick, but not quite painless ;)
 
when the recovery guy FORCED open the door it bent it in allot, then dragged the car bending it up... meaning i couldn't open the door without damaging it more, got the body shop near me to pull the wing straight and clear of the door, but itd cost more than £20 to straighten it properly in prep for paint....so cheaper to replace it with a straight one....ill take a close up of the wing in its current state, there ALLOT of mangled wing under the side skirt.
 
Sorry to hear about the damage caused to your car mate, but at least you're now back up and running again, which is good to hear (y)

Have you had a look around the area where it happened to see if there are any CCTV cameras? At the end of the day the cyclist has failed to comply with a Red light, so there may just be a small possibility that you may be able to speak with the police about charging him, if possible and if he can be identified, which may be hard!

I know it's a long shot but it may just be worth it.
