We had new neighbours move in to the flat above us a few weeks ago. The saturday night they moved in, they woke me up with loud music at 3am.
I sent my OH up there to ask them to turn it down and they did. Only problem is, it keeps happening. Every weekend both Friday and Saturday nights I can hear them. It's not especially loud now but I can definately hear the bass coming through the ceiling. Normally, I could live wth it, but it never starts until about 1am!
Lastnight I got the hump. Having done a 14 hour shift, just going to bed and they started. So I went up and knokced on the door. Told the guy it was very late. He apologised but didn't actually turn it down. He looked really stoned too and the flat stank!
I was sat here at 2am this morning listening to the beat and firing off a complaint to the housing association.
Now I'm not sure what to do.
Do we have any legal rights over this does anybody know. Do the housing association have to do something or am I going to have to go slowly insane through lack of sleep and long shifts.....
HELP!

I know the feeling, I have got a 65 year old granny,next door. Who seems to be busy with most blokes in the local area. Not the noise, I'd like to wake up to, or go to bed to for that matter.:yuck: Worst is when she tells me about the men who are married and how she loves them. But which one? Argh, I am so glad I am buying a new house in few weeks. So no more. Sorry had to get taht of my chest...:bang:
 
You will be asked to keep a log of what the problem is and when it happens, write it down every single time, so start right now and try to include the previous times it has happened. They will send you a form to fill in so just transfer all the previous details to that. I think it then gets put into the hands of the environmental health noise pollution department and they will then monitor the situation after measuring the sound, they will take into account that the later it gets the lower the noise tolerance is.
We had a right w*nker living next door who used to come home drunk and for some reason he suddenly had courage and seemed to forget that the previous day I had told him if I heard it again I'll break his neck. He was all apologetic when approached in the day but it never stopped him from banging the walls, playing really loud music, sh*t stuff at that, and just being a pain the arse.
Eventually he was evicted, and I stood outside watching him leave, I even waved to him as he went :nerner: :tosser: :wave:
 
thing is.. if you lie there in bed for long enough you can hear anything. if you think about it, loud music is down to relative term. if you are use to no noise at all, then any music will be loud.

not saying you should do nothing, but just highlighting that housing assication might not do anything either.

ask him to move his speakers off the floor, turn the bass down - or just stop playing music at silly times, or buy him some headphones
 
cripes do i know this feeling well. At my flat i had a tosser who lived below me and he would start playing music at stupid o'clock on a sunday night just as i was climbing into bed. I lived on the top floor and made a rule never to play music as i didnt think it was fair to my neighbours, but the bastards in my flat didnt give two hoots for my feelings, lucky for me i moved out and bought a house. Life in a flat or maisonnette is always going to be difficult, especially if you are in an older flat as the flooring is all floorboards and not concrete like the newer ones, its even worse if you have tenants as 9 times out of 10 they dont give two hoots about people who own thier flats, they take the ****, run the block down and then usually get evicted!

All i can suggest is that you do as KOA says and log everything then take it to your local councils environmental health, if they feel that you have a genuine case they will supply you with noise recorder things that measure the noise levels etc and then can issue the necessary on your neighbour. Just be careful of them though, i know of some people who reported thier neighbours and then got assulted!
 
Ive had neighbours from hell for 20 years!! Now the youngest lad is 18, his mother[who lives without hubby there], goes away 2 weeks at a time regular, and he has 2 week parties!! They do not stop until gone 6am!! They are obviously taking speed or similar to keep them awake as they never seem to sleep. My problem, is they have a lot of local family members and friends, so if i kick off, i will get a beating[thats the type they are]. So my next step is to report them. Its not straight forward, as the officer who takes your case, needs to witness the constant noise. The laws under the noise abatement laws, state decibels from neighbours between the hours of 11pm and 7am must not exceed 25 decibels constant, with the max allowed 35 decibels. Well being used to motorsport, i know what 70-90 decibels sounds, and they are easily matching and well exceeding it. Fortunately, with the recent changes to the law, you can get an ASBO on the house and person involved. Fines can range upto £1000 and allow the authorities to confiscate HIFI's and anything related to music material if the fine is not paid. Then its a prison sentence.
If the neighbours are paying rent, then its quite easy to get them evicted. My problem now is, iam so lacking sleep, iam willing to do anything to stop him, even wipe him out. That worries me if i snap. Police ive rang numerous times, for them to say they are too busy. My local nick is part time and i had to leave a message for the police to return a phone call 2 days later!! Where my local nick is, is a high crime area, so WTF is the nick closed half the time for!!!???

This why I love old houses. Our walls are 2ft thick granite blocks(y) We watched movies reasonably loud in the evening before baby came along. Not one complaint.(y)
 
My mother has just been through all this. It stinks that irresponsible tenants seem to have more rights than the neighbours they disrupt :mad:

However, you need to contact the council Environmental Health Department as others have mentioned. But be warned, it's a long winded process with no guarantee. You'll have to keep a diary of ALL disturbances, and if you're lucky the council will install recording equipment to monitor noise levels. These recording machines are in high demand so it can be difficult to get hold of one.

If the noisy tenants are renting the property, find out who the landlord is and complain to them. Often they have signed an agreement about noise regulations and could well be in breach of contract.

If all else fails, then give the noisy bastards a taste of their own medicine. If they keep you up until 3am playing loud music/ having parties, then perhaps they won't like it when YOU play loud music at 7am as they're trying to sleep off a hangover. :devil:
 
We had similar problems a few years ago.

After doing the polite, then the impolite then the environmental help routes.

We moved.
