I read and heard on the news today that the Glasgow bin lorry driver who apparently blacked out and as a result 6 people died , lied repeatedly about his health record.
I assume this means that whoever insures the council's fleet will not honour any claims that the families may have had against them?
It may not be the first thing on their minds having lost a loved one, but it is going to be a right legal mess isn't it?
 
It's a difficult one because the initial faint was in 2010.

I've sort of been following the case and he had nothing else since then and had he disclosed that one faint it 1. Might have cost him a job, but 2. Wouldn't have meant he was unfit to drive and to do the job obviously passed medicals and other such assessments.

I know the family wanted to bring a private prosecution but it may prove difficult to get anywhere with such a sketchy history.
 
I can imagine the insurers will claim that he lied and if they had known his medical history they would not have insured him to drive, especially not an HGV or PSV.
