Right this is a long one but bare with me..

i had been looking around for someone to respray my sports car, i finally settled on a bodyshop that was recommended by a friend i went and spoke to the owner we walked around the car etc. spoke about what i wanted, he said bring it in 2weeks when they will have a free slot to take on a large job such as mine as its a bodykit and colour change respray.

fine i said, i brought the car in on the 26th of June 2012 and dropped off the bodykit at the same time, he originally told me 2500 and that it would take 2weeks, i thought it might run over abit say until saturday which wouldve been 2weeks 4days i hadnt imagined id be staring at a calender saying August!

it is now the 9th of august 2012 and my car from what i understand is still in primer with no date or hint of a the finish line given or in sight.

i rarely get threw to the owner i think i have spoken to him 4-5times since i left the car there, i receive various stories and apologies when i do but again no date for completion, i demanded it be done by last Saturday only for him to finally return my calls in the afternoon explaining that its in the paint booth there was an issue with the primer. with the excuses i have received i think its just been left sat in the corner whilst they do other jobs.

i posted on a social network site very recently that i was annoyed about the job being 4-5weeks late and that i regretted using the bodyshop and starting the project at all - the comment was set to be seen only by a select few friends, inclusive of the guy who recommended me, who has clearly told the owner. the owner then text me with swear words etc. to which i calmly replied my displeasure and haven't heard from him since. the comment wasnt slanderous or a direct attack i chose my words carefully although in hindsight i shouldn't have posted anything.

When i have had communications with the owner he/she has mentioned via telephone (i didn't receive any email communication like he has promised to send over and over again) that there will be extra costs involved, another 200 for the wheels, which i understand, he also said he forgot the price of the window removal and refit and that was 100-150 extra. he asked for the final payment to be in cash and i asked what was the final amount via text so id have written proof i didn't receive an answer but on one telephone call he said lets sort all that out when you come to collect.

i know all this will sound juvenile and pathetic but i genuinely don't know what to do next, i cant force them to work harder myself and i don't want things to end in a dangerous manor clearly, i just need advice on any steps i can take or should be taking now?

where do i stand legally?
is there anything i can do to push the job along?
also what are my rights when/if i get my car back and the job is substandard as i think this may become an issue because of his anger in regards to the social network part even though it was removed after a request from the friend of the bodyshop who recommended me.

my worries are now that he will take more and more weeks to finish or that the quality will now be compromised, i dont understand why i became the bad guy in a job over 3times late and more expensive than originally told.

Ouch.

Sorry to hear this, when you took the car to him, did you get a written quote or contract ?
Word of mouth is very hard to prove, if it gets that far.

Try to remain calm, ( easily said ) how much have you paid out so far ?
Are you a member of the AA / Rac etc ? they have legal depts for members.....

Its a shame, people like that give the rest of us a bad name.

You've probably past this point, you've slagged him off online (justified or not) and he now has nothing more to lose from pissing you off further.

Where is the body shop in comparison to where you live? Did you not think to drop in and find out whats going on?

You should have gotten a written quote for the work otherwise he can do what he is doing and bumping up the prices. Is would have also given you a estimate of the time scale, basically you've been an idiot and he's serving more lucrative customers at your expense.

The fact he's started the work means he is entitled to payment for the work he has done to date, however if you can prove the work is below standard you might be able to aviod payment and reclaim your car, then you get into the problem of him potentially damaging your car or losing bits leaving you to prove your case.

At the end of the day you need to go talk to him stop using the phone because it's very easy to fob you off (which he has done)

The other solution would be to set in writing the situation his promises and your expectations the current situation and a solution to move forward, and get something from him down in writing.

At the end of the day he's started the work and has your car so you're on the back foot.

It's well worth going to your local citizens advice bureau as they may be able to mediate for you.

I would echo the above. I know its nice and easy to get sucked in with the excitement and whatnot but in writing is the way to go.
As for the social network incident, what exactly did you post? If it is indeed slanderous or indeed libelous (and its very easy to do. One wrong word) and you're screwed.
When you see the CAB be totally honest with them. If they can help they'll only be able to build a case based on fact and if you miss something, you're dead in the water.
Can you take another sprayer to look over the vehicle to see if its sub standard work? You may be able to get it for free on the basis that he can finish the work.

I cant see another sprayer finishing off the work for free. I wouldn't.

Any joy with this ?

Nooo, I didn't man for free...
Let's face it, it looks like James has royal peeved this guy, so the chances are the job will either not happen or it'll be rushed and look awful. He's gonna need another sprayer to complete the job, so either way he's gonna have to pay twice.
Saying that, the original paint shop may finish it off nicely.
