As of 11/12/11 I am no longer a stilo owner. Some goon in a renault scenic decided to have a light-less jolly round cardiff with his kids in the back and ended up smashing into me as I was pulling out.
I ended up being spun nearly 180 degrees by the impact and caught a parked car with my rear end as I spun. As a result the stilo has been written off with a bent rear axle, buckled drivers side rear wheel and body work damage all around. Supposed to have been a 20mph impact ;)

Shame, I loved that car and not so long ago I put a good few weeks work into her with my mates doing an axle change, new gearbox etc.

Anyway, what do you guys reckon she was worth? I've been quoted £2495 for her by aviva. Doesn't seem a bad price according to parkers but I'd prefer some more opinions!
03 plate Stilo Dynamic MW 1.9 JTD (115). 90k on clock, FSH.
Silver Metallic paint ,Panoramic sunroof, dual zone climate control, split opening boot, cd,mp3 radio w/ 6 speakers. No mods.
Can you guys think of anything else that I may have missed?

The whole thing has been a nightmare. Fiat aftercare have been useless and aviva have been trying to charge me because fiat were involved even though no repairs have been carried out.
Not to mention the coppers in cardiff and that silly clown who decided it was fun to not give me any insurance details and to start throwing random accusations around!

try and hold out for 3K, even if they meet u half way at 2750ish, its more than they originally offered (y)
look on autotrader and other car sales for stilos the same/very similar to yours, and if they are up for more, then show your insurance company this, to show them you cant get what you had for the money they are offering

Argh, I forgot how bad AT could be! Even if I set it to have ads in descending order by price it sticks them in no particular order.
Hmm.. I'm in a spot here. Mine has some extras that don't seem to be on any of the cars in the auto trader. Pricing seems all over the shop on there as well.
Does anyone know if the split opening boot was standard fit or an extra? I'm told by some that it was and by others that it wasn't.

UPDATE!
The cheque came through. I was offered £2600 with an excess of £350. Now a cheque comes through for £1925 and an excess of £550! I'm also to blame by default because I was the one "joining the flow of traffic" from what the goons at aviva are saying. They informed me of that, adding "that's the law states"
Is that true? Does the law really consider you to be at fault even if it wasn't your fault?

I just love it when they screw you over :bang:
 
Probably not what you want to hear but yes, if you were joining the flow of traffic from a driveway, T junction, slip road etc. then it's your responsibility to do so safely. I believe the word of law in such circumstances is something like; You shouldn't do anything that would cause another driver to alter speed or direction.

You may have a partial defense if as you say the other driver was "light-less" but only if the road was so dark that it would have been impossible for you to see him without his lights on when they should have been.

with out hands free at the time then it's classed as his fault.
Collect all the info you have to back up the purchase price of
a vehicle in the same condition and milage as your own and tell them
the amount offered is not enough and why - do not cash the cheque
as this signifies acceptance of their offer. Then see if
they offer more with evidence your cars market value
is greater. If they increase the amount accept the offer.

It was in the evening around 1715 on the 11/12/11. It was on a busy street that had loads of cars parked up on either side. To see anything you had to creep out until you were maybe 1/3 across the road. In short it was absolutely impossible to see that guy coming before it was too late.

It's bad enough that it occurred but put all of the foul ups, bad attitudes, big egos and prejudices of all involved on top of that it becomes nigh unbearable. It's been a nightmare from the very start :x

I don't know if there was a phone involved BUT I do know that there were 2 young children in the car with him. Sadly all the witnesses very quickly scooted off before the initial shock of the accident wore off. As such it was my word against his!

I know one thing for sure though. I certainly will not be doing business with aviva again and shall be letting all around me know of my experiences.

Unfortunately, not being able to see whether anything was coming because of stationary objects (parked cars) in the road is not going to be a defense. It's still your responsibility to pull out into the road safely.

No idea why they've deducted more than the agreed excess. When you took out the policy, it was a contract between you and the insurance company and part of that contract was that you pay an excess of £350 in the event of a claim. I would be asking them why they've broken the terms of the contract.
 
Is the 350 the total excess or the voluntary excess? They get you that way - my insurance has a £100 compulsory excess, and 0 voluntary excess. My guess is that you have 350 voluntary and 200 compulsory excess.
 
Thanks for advice guys. This whole situation is a crummy one and in this case I think the law is dead wrong and unreasonable but who am I to challenge it being a simple citizen (and ex serviceman) of this country?
I am absolutely tamping.

That's a nice looking car there. Tempting but the mileage is a little higher than I'd like and I'm a 5 door man through and through. Nothing like not having to stretch for that seatbelt when you jump in the front! :D

Unfortunately it does sounds like the collision was your fault, you've got to turn the cards around and ask how it could have been the other drivers fault? :(

The rule about the phone isn't strictly true, the driver would be breaking the law using the phone in a hand, but not automatically liable for the accident, only if it could be proven that this act caused the accident.

As for the excess, check your policy documents, if once you've done this you still think you've been charged to much for the excess call them up. All calls are recorded so if they cheque is wrong, with the correct excess being deducted then they can raise another. Just give them a change. Unfortunately mistakes can happen!

Have you got a Total Incident Manager assigned to your claim :confused:
