evening

had a letter today off DVLA, my sei which i traded in part ex back in november is still licensed in my name and the tax hasnt been paid. they are wanting me to pay the tax and a fine. :(

was i supposed to get a confirmation off the DVLA for recieving the old V5? as far as i know the fiat garage i part ex'd it in have sold it on so why havent they had theres bounce? any ideas? my heads screwed over this!
 
no you dont get a confirmation. normally new owner sends a peice off to say they bought it, and seller sends of a thing to say they sold.

i certainly wouldnt pay the tax or the fine it not your car. i would go speak to the garage or contact dvla. was something like this on watchdog other night about there computers making mistakes
 
dealer never sent log book of when i pxd my old car, the yellow bit they suppose to fill in was still attached to rest of it when i asked to see it

i had fine and paid but got money back of from garage
 
Whatever you do keep ALL correspondence they send you, as in their eyes it's up to you to prove you've informed them that you have sold the car. If you don't or can't then you will end up having to pay the fine.
 
Whenever you sell a car, or part ex it, get a signed written receipt from the other party, dated and time stamped from the time of the transaction.
Then complete all the actions the seller is obliged to by law.
This way you have done nothing wrong, you can prove you were not the owner of the vehicle when it incurred any fines, including any speed camera fines by the new owner before such a time before the paperwork has been processed by DVLA.

All fine and dandy, so the DVLA take me to court, unfairly, and I sue them for stress, loss of earnings and costs! (y)

My point is... Do all you can and should do, and as the bottom line of your linked article indicates... "the case will not be pursued"

Dont do all you should do and then you may indeed be culpable.
 
Isn't it the legal responsibility of the ex-owner to fill in and send off the large part of the registration document and to only give the new owner (garage where it was part exchanged) the new keeper supplement? I'm sure the V5 makes a big deal out of that.

However, if there is a written and dated receipt clearly showing the vehicle has changed hands then it might be possible to contest the fine, or at the very least get the garage to pay it.
 
the garage have done nothing wrong. if you partX a car and give them the whole V5 then its your own fault. next time read the V5 and fulfil your legal obligation to nofity DVLA.

:yeahthat:...and keep all/anycorrespondencee. A couple of the examples given in the Watchdog episode could not produce the letter from the DVLAacknowledgingg the refund of the remaining road tax, and as a result they were pursued for the fine.
 
I got loads of agro off a car back before the new reg doc. In those days you PX a car or sell and the new owner has to register it. I got tax fines, speeding tickets, parking tickets, police at the door after a hit and run. It took about 6 months to sort with the DVLA.

The new reg doc is so much better if you can fill it in properly. If not see above lol.
 
i'll never understand why they did it like that. it was a bloody stupid system.

Was from those days when you could leave your front door unlocked and when you got home all of your stuff was still there.
 
evening all, sorry for rushed post last night, was peeved off and didnt explain well. did some more reading into this today while in work and spoke to fiat about it too.

basically i part ex'd it for my punto at a dealer. i sent off the yellow slip but by the looks of it it was never recieved by the DVLA (my typical luck). When reading my current V5 today i discovered that i was supposed to get a confirmation letter, so thats why im guessing it never got to them. Bad way to learn that!

however i have no way of paying the tax, i have no MOT or insurance for the vehicle so have no way of taxing it. i spoke to the dealer and he said he had traded it on to another garage, wasnt specific who to or knew where the car currently is. he said i have to right to the DVLA and say i sold the car to the dealer and incllude a photocopy of the part ex document. he said the DVLA will then get in contact with fiat and chase the route of the car and track it down. so by the looks of it im off the tax, however noone seems certain about wether ill pay the fine. will just have to wait and see what the DVLA say!
 
Always use recorded delivery, atleast you have some proof it was sent.

I bought a new car a few weeks ago and still haven't received the V5. The DVLA confirmed they haven't received notification of change of owner and the guy I bought from hasn't bothered to respond. If I don't tax because I can't the onus is on the seller to notify the V5 of change of ownership and he will be fined.

I have proof of ownership in a receipt and the small green slip if I get round to sending off before the tax is due :rolleyes:
