Just need some advice about an accident that happened in October 2009 to my Panda 100 where another driver crashed into it :(. The story is as follows and what is currently being done about it.

I was driving down a main road heading towards my turning which was a right hand junction turn, my indicator was flashing as if I was turning right and I was approaching at reasonable speed of around 15MPH.
As I made my turn which obviously crosses the oncoming traffic lane a car waiting at the junction of the road I was turning into suddenly pulled out without looking left and impacted my rear quater mid turn.

The impact was a point impact where the O/S corner of his front bumper crushed into the arch of my O/S Rear doing considerable damage to underneath the car arch, alloy and bottom of O/S rear door as well as the sill total damage was around £1400.

At the scene he admitted liability and gave me all his insurance details and even offered to pay there and then but I told him that the damage might be far more than it looked and I couldnt put a prise on how much it might cost! So we parted and I contacted eSure with the details and thats when the nightmare begins!

Its been going on now since October 2009 and he is now saying that I side swiped him and he was stationary waiting at the junction which is a complete lie! I am actaully a coach driver and am use to cornering 40 foot vehicles around tight roads there is no way I would side swipe a car while driving something as small as a Panda! This claim has now gone to court and I am having to provide photos and everything else you can imagine! The problem is my insurance has just gone up from £420 a year to £1300 which is a huge increase and I dont think I can afford to keep the Panda 100 with that kind of Insurance!

So here is where I am asking for advice about eSure until the court case has gone through... Can they actaully put my premium up this much until proven guilty and is there anything I can do about it??

Im worried it might go 50/50 with eSure and Tesco and I get penalised for something ive not done!!

What I dont understand is that was last October, until now I have been paying my £40 a month premium and now my renewal data has come up and they have slapped it up massively! Must be just because its renewing with a claim that is still unresolved!

Also On my renewal documents it states I now have 2 Yr's NCB down from 4 Yr's NCB and the claim is shown as outstanding so it hasnt dropped to 0 NCB yet its still £1400 for an almost 25 year old, can only shudder if that had reached 0 it would be over £2000!

Good luck with the court case, I sure hope it goes in your favour.

As you have discovered, admitting liability at the scene of the collision means nothing.

Unfortunately insurance companies do (legally) rip you off. Have you tried getting quoutes off a few different companies.

But like others have said,unfortunately you have a non resolved claim hanging over you still, so you're insurance will more than likely go up.

Make sure you protect your no claims bonus when you get it all sorted, it's certainly worth it.
