I have just opened a letter from South Wales Police informing me that I was caught doing 88mph down the M4. I now need advice on what to do next. I was thinking of sending them a letter saying that I want to see the photograph because I don't know who was driving the car at the time, as a lot of people drive my car on their own insurance. However I just rang the telephone number on the letter and it was an answer phone message and it said that the photograph doesn't identify the driver of the car (so why does it say on the letter that they have photographic evidence of the offence). Should I just fill out the part that says I was not the driver of the car? Good advice from people with experience of this would be greatly appreciated.
 
tough one, u could fill it in but u may have to prove u weren't driving at the time. can u remember where u were at the time? any ideas who could have been driving it? tick the box if ur sure it wasnt u, it'll probably be a £60 fine and 3 points for who ever it was.

I got done in whales back in october on the way to the British rallye Si was with me too. I'm still pointless!! 84 in a 70. take me away officer!! sob sob I'm so sorry! hehe

All you are is data and money to them. My brother followed the website and got away with it when he was caught but the mobile scum cameras!

I've actually asked a policeman about this and he backed me up. (was nice police guy not a traffic dibble tossa) If you can string em along for 6 months you get wiped from there system! I'm four and a half months into it and I've just got a picture of the car through.

I've still got to ask for a copy of the gatso gun calibration certificate for that day.
Then I've got to ask for a statement for the the asswipe who caught me! This is where I got my info from. good luck

So send a letter asking for the photo and don't sign anything yeah? should I send the the stuff they send me back and enclose my letter in their freepost envelope, or is that taking the ****?
 
A nice thought

If they do send you a picture of you causing the offence, why not return the favour and take a picture of you putting your cheque in an envolope and post it back to them.

Even if you weren't driving at the time it is your responsibility to tell them who was. I have tried to blank my memory from getting done myself last year; but does the form not say Drivers Details if not your own or something along those lines? You've got 2 immediate options: you say you were driving, take it on the chin and become another statistic or you go down the photograph - detector callibration form route which is no guarantee of success in my humble opinion.

Careful if you say you weren't driving unless you're sure. If it turns out that the guy in the picture has an afro, and you give details of a lady with long blonde hair you'll be in trouble.

I not signing my name to anything untill i've seen the photo. If its clear that I am driving I'll pay the fine but if it unclear i just say i wasn't driving and don't know who was.
 
Advice - Speeding

The law requires you to identify who was driving at the time. If it was not you, you need to be able to prove where you were - e.g. a credit card receipt or ATM transaction at a similar time in a place where you could not have reached the speeding location at the time of the alledged offence will do.

Having said that, failure to identify the driver of your vehicle can carry the same penalty as the offence i.e. up to 6 points and a fine.

If you can say who was driving it is in your interest to do so.

Trying to avoid or delay can work, but it can also cost a lot if it fails - you pays your money and takes your choice.

In principle I agree with what you say but am I not correct in thinking that recent high profile copper got away with speeding by stating under oath that he didnt know who was driving (him, his wife or his daughter). The picture was inconclusive, he didnt have prove he was elsewhere. Secondly, I question your comment about cash and delay's. Asking for photos etc is allowed under due process and there (as I understand it) cannot be a threat of a greater fine (maybe an admin charge??). You are merely substiating your guilt/innocence and this it is against the rule of law to threaten this right of defendants through any means (although right to trial under jury is another matter!!!!!).

One thing that is common to all the web sites giving advice on speeding and the law is that if it was you, and you know it was, and you were doing more than about 5-10% over the limit, own up cos it's not worth it.

I got done by a mobile camera just after buying my bravo, 78 in a 50... Ouch !

I put my hands in the air and said fair cop... £60 fine and 3 points SP30... never caused me any problems, and come this summer the points are gone !

just a few points

As I understand it any photo taken cannot include the drivers face, as apperently you could sue for Invasion of Privacy.
Some forces will persue you to the ends of the earth for the offence, the vast majority will not. As a result most forces will send paperwork a couple of times and then deem it to be toexpensive to follow up(you got away with it).
I also got told by a solicitor that failure to identify the driver will result in a fine, but they cannot put points on your license.

This may all be wrong, not sure but it was what I got told when I got done.

I was photographed by a mobile unit on the M6 just over a year ago. I was snapped doing an indicated 101mph, had I have admitted the offence then I would have been banned,fined and recieve points on my license. I did neither I strung them along for two months by basically ignoring them, on the third month I got a summons for not identifying the driver to which I pleaded guilty by post.
I got no ban, no points but I did get fined £300' ish.
This means my insurance is still the same and I have no points on my license.

p.s. For them to ask you to identify the driver is self incrimination, which they cannot force you to do as it breaches your basic human rights.
 
ok I'll say it agian

string it a long for 6 months by what ever means and you will be wiped from the dadabase. It worked for a relative and an actual police man backed this up. Look on the site and it will back me up.

All you are is data, a number on a server some where within a police station

some guy got away with a ticket by not signing the paperwork.

Not advice, but 2 out of the 4 times I have been 'snapped' speeding it was while doing someone a favour!

Yes I heard the story on Radio 1 newsbeat yesterday. Something about it puzzles me though. Why didn't they send the form back to the guy and ask him to sign it? As for my progress I have written a very polite letter asking for a copy of the photograph and am praying that it doesn't clearly show me driving. Do you think it is likely that they will take me to court if I say I am unable to name the person who was driving?
