400kms after having timing belt kit replaced, the bolt holding the tensioner failed. Valves destroyed and head needs work on it. $5000 later
my normal car mechanic says two things would cause it
1. Bolt not tensioned correctly
2. Bolt fractured

I have a couple of questions.

1. Does the Fiat repair procedures state that you should change the tensioner bolt when changing the kit? Where do I
find this info?
2. Is there any way I can sue the repairer? The repairer says that it is just "one of those things" He hasn't shown me the fractured bolt

$5000 damage after 400kms is ridiculous. One wouldn't imagine that you would keep a 15 year old bolt for such a critical part. The cost of a new bolt is nothing
 
Don't know about Fiat dealer procedures but Auto Data doesn't specify new bolts.
It would have been good to see the old broken one. Tend to agree with your normal mechanic , but without an independent engineers report at the time, hard to prove.
On Iveco Dailys with same engine if the belt breaks , the same on many modern engines, the valves hit the pistons which is bad enough but the conrods bend also. Pretty obvious with head off as the two up and two down pistons are not at the same height from the top. Unlikely to be missed but if sent out like that I imagine it would run like Sh*t. So if you had those replaced it may account for the bill.
