A quick hyperthetical question.

Someone hits your car, you claim through their insurance, if their insurance company decides to write off your car, are you allowed to say no, I want it repaired. Or is the decision down to them. If it is written off, how do they determine the value?

Not happened to me, just thought about it this morning and wondered if anyone new?
 
i think the decision is down to them! not to long ago they would offer u the car back and a lower settlement price for the car but im not sure if they do that any more!
i think aswel to get it valued they send it to a mutual evaluator who asseses if the car, had been in any other accidents, the condition prior to the accident and ask to see and service history for the car!
they do tend to rob u a bit tho as i got an awful price for my 216 coupe last year :(

you are wrong there :)

If another person hits your car, and there is no dispute of blame - then you have a right to have your car repaired back to exactly how it was before it was hit. If that costs more than the car is worth, then so be it.

cnt really b wrong if thas wat they did with my car!! the accident wernt my fault and they accepted liability straight off but i didnt have the choice wether i had my car back or not! wen it was valued it was found to have been in an accident b4 hence the reason i got a naff price but was damaged beyone economical repair hence classed as a right off
 
if at any point you'd said, "no - you're not going to write it off" then they wouldn't have. they were just looking at the cheapest outcome. end of the day if your car is hit and you are in no way to blame, what good is x amount of money. You didn't have a cheque to the value of your car, you had your car.

when does indemnity have anything to do with a third party total loss???

if liability is admitted an it's deemed a total loss then its a total loss. we right it off and send you the cheque. we never budge either. your right in what your saying about putting someone in a position they were prior to the accident but insurers dont give a flying f**k. the cheapest option is the way we go.

What if it rolls over, sets on fire or the chassisis bent? Gets wrapped around a tree, t-boned or splits in half? If the car was repaired, it would be unsafe to drive, thus insurance companies will not repair it or give you the option to have it back. They give you money and then it's up to you to buy another of similar age and value. If you were desperate, you could go to the scrapyard where your car is kept, buy it back, and then do it up with the money you were given

All depends. Twisted chasis are sometimes fixable but at great cost.

And insurance always have to give you back car if requested, no matter how badly damaged it is ;) (y)
