HELP ON INSURANCE CLAIM PLEASE
basically - my cars been written of due to some **** who went thru red lights and hit me in drivers side on a roundabout. at the scene he admitted to me it was his fault. to the police he said that he went thru amber and didnt knw wat happned (this is what the police said to me when i asked the mabout his statement - he wasnt blaming me) now he has told the insurance that i am responsible for the accident!!!! i dnt knw wat to do as there r no witneses ( well there was but at the time i was in shock n didnt knw wat to do - i paniced
) ii cant lose my no claims (2 yrs) other wise me is f**ked ne help or adice wud greatly b appreciated. also how do i speed up the settling of the claim, when speeking to the claims manager man. i been without a car since 19th of May ,and lost out on a couple of months of insurance

Bit of a bummer mate. It sounds like it was one hell of a smash. A similar thing happened to my uncle about 5 yrs ago. Did the police do a detailed accident report on the whole thing with the cars in the same position of impact? i.e. if they did they should be able to work out roughly how fast YOU were going at the time of impact, i.e. I would assume that the lights turned green and you pulled off? If this is the case then the police would have a fair idea that you were pulling away from green lights. Since they would also know the timing of the traffic light sequence and probably the rough speed of the other car that should prove that he went through a red and not an amber light. Of course this is no good if the cars were moved to the side of the road or anything (in my uncle's case, he got hit at around 45mph and so neither car was in a fit state to move). But just from amount of and area of damage to the cars they should be able to tell the relative speeds of the cars. Other than that, with no witnesses you could be in trouble, he seems to keep changing his story so if it came to court or anything, a lawyer would make mince meat of that....not much else you can do apart from sending round some mates to kick his head in!

Oh yeah, forgot to mention, as long as you can prove that he was to blame then you can claim back your 'lost' insurance and any loss of earnings. I hope that you went to the hospital after the accident, if only for a check-up - if so, you can get compensation for whiplash etc etc because your file will be on hospital records. Regarding speeding up claims - you have no chance, even if the police can help you show his guilt, his insurance company will do everything they can to delay the procedure if it is in their interest. You may be lucky - if the police have good accident report evidence then you will receive a cheque v quickly, if not then it could be Autumn before it is all settled.

cheers gaz - the police did say he werent blamin me initially n my insurance co r aware of this so they r therefore getting a copy of the police report (which is on my side n backs my story up - more or less), my insurance co have requested a drivers history for me which shud cum thru tomorrow. that seems to be the final hurdle b4 i can get another car. this has been so much headache its unreal - i hope no1 gets involved in an accident cheers again gaz
