I tried to buy a morris minor off someone i used to work with but it went sour. I had the car in my posession and it was outside my house. I had paid the man 400 of the 600 he wanted but i was stuck for the final 200. I decided i would sell on the car and then pay him from that and was offered 1000 for the car and thought great a bit of profit aswell. The morning the dude was coming to buy the car off me i heard a noise outside and lo and behold the man was there taking it back, apparantly he had kept a spare key for it along with the v5 till i paid him. He said he was unhappy i was making a profit off him and that he would be taking it back. At first i was a bit angry as i would lose the 400 in profit but after a couple of coffees i was calm again. I rang him and said that there was a guy coming to buy it and woud he like to sell to him and i could get my 400 back and he said ok and i took the time and made the arrangements. He never sold it to the dude in the end (in truth he never turned up to show him the car). My point is he said he would give me te money back otta the money when he sold the car as he wont give me it outta his bank. This was 4 weeks ago and now he is not answring his phone when i ring and i tried off a mates and he hung up when he realised it was me. My question is i know where e lives and should i go round and speak to him and if he wont give me my money do i hve any rights as here was no receipts or anything. I could threaten him if i thought it would get me my brass back as i could do with as i am on the sick.

have you got the spare key?
if not just go round there and say you want the money or the car if you dont get them then hes gunna have to start worrying cos if i was you id go round there and make him, you would be suprised what people can get to gether when they have too.
 
if you've still got the key get it back and take it to the crusher, then deliver it back to him in a nice cube.

Highly ilegal i know but then you have done nothing wrong in the first place.

Keep hounding him he will get bored soon.

If he contacts the police then hopefully you can show the date that the £400 was withdrawn from your account.

They will then look at his account and if £400 or around that figure has been deposited near that date then you will have a fairly strong case for the law to get involved.
 
I would not loose my temper, that is the wrong way to go, the worst threats come from calm people as i believe they are most likely to deliver lol, just go to his, simply sya you have the spare key and if you dont get the £400 one of two things will happen, number 1: you will make his life very VERY hard, number 2: you will go to the police, by rights he owes you £400, ask him if that is worth possibly loosing the car due to you taking it back with the spare key, the hassle of him having to change the locks on the car and most of all the thought of having to look over his shoulder all the time
 
After reading your posts a couple of times to make sure I understood all the details, lets just recap.

Did you pay cash or cheque? Do you have ANY proof, ie, Receipt or anything to proof you paid the cash to him? The police would be reluctant to get involved as from what I gather (if you have no proof of giving him the money) then it would simply be a case of you saying I have given him the money, and him saying no you havent. You are therfore left with the simple option of making life unpleasent enough for him to decide that the best option would be to give you the money back. Have you any big mates? They could simply drive up tp the car and stand around it, looking as if they are going to pinch it,BUT, doing nothing ilegal and maybe this might start to worry him. On the other hand, my mate was owed money by a guy who wouldnt pay and so he went round the guys house, left a full pop bottle on the front step (filled with petrol) phoned him up and said "if you dont pay me, the next one will be lit"....worked:)
