I hope that agreement is legally binding......you don't want to pay for it twice! What idiots, can't believe they have done that.

Hopefully you will get a good deal at the auction. Don't tell the garage what you paid...
 
You will definitely get your money back from the garage as they must have title to any goods they sell. You will also be entitled to costs if you incurred any.

The only concern is that they suddenly go out of business, I have know idea how big they are.

The guy who traded it in also committed fraud as he would have had to make a signed declaration to say the car was free from any loans secured on it. It is a criminal offence, although he is unlikely to be arrested for it.

This is the sort of thing that really makes my blood boil. The legal system in this country is a f***ing joke. If you buy a car in good faith, and it turns out to be dodgy, the seller should be held responsible. Instead, the poor bugger who buys the car loses it and gets f-all of the cost back. What moron thought that one up??? :bang:
 
Sad but true, even if somebody owes you money and you get a court ruling it can still take months and months to get it back. You also have to pay all the legal costs in the meantime.

The garage were a bit stupid not to check it though.

Hmm, don't I know it, my landlord from last year is a w***er and still owes me my deposit (I moved out in June last year!). Think I'm gonna skip all that expensive and tedious court s***e though and just find out where he lives, then spend an evening waiting outside his house with a baseball bat :devil: :mad:

Probably a lot quicker and cheaper way of doing it.

this happens to loads of people, i reckon if you rent anywhere and have paid a deposit, dont pay your last few weeks/months rent and get it back that way :Offtopic:
 
Just a quick word here :
Its quite possible that the guy who sold/traded in the car did not know there was any loans secured on it..
When my mum got her new car, she just took out a loan with Fiat thinking it was like any other loan that she had i.e secured on her property..
Nobody explained a thing to her about the loan and it wasn't untill i did some digging around that she found out otherwise..
The garage did not at any point tell her it was secured on the car.
Maybe there should be a law that states these things must be made clear in a verbal statement.
 
Well, its defient for this friday! So im just waiting for friday!! :confused:

But ive decided to buy a brand new 1.8 stilo if i dont get mine back?! Does anybody know how long it would take to get 1 built from the factory?! Hoping my dealer will match jamjar prices?! Want quite a few extra toys like me old stilo so wont be able to take 1 off the forecourt! But thats only if i dont get me stilo back; which im reallying hoping i do!!
 
When I purchased mine I was told it would take between 10 to 12 weeks because I wanted panoramic sunroof, subwoofer and mp3 player, but it took around 8 weeks to pick the car up so I guess thats not too bad.

I think for all the grief you've had you might as well purchase a new one.

Also you should be able to get yourself a good deal. I found a great price from coast2coastcars.co.uk and my local dealer beat the price so I saved myself nearly 3k!

Dealers if you are well prepaired with all the prices and extras you want on, will eventually match or beat JamJar or other online car dealers prices.

Plus if your going for HP make sure they also match or come very close to the lowest APR% rates at present otherwise you may know the price down but pay it back in the APR.

There is a good article in this weeks Auto Express about the scams used in buying/selling cars. It makes some good reading, and much of what it explains is counter intuitive.
 
Well, its nearly friday now; so fait ull take it cause! :confused:

But the website i wanted em to price match was broadspeed.com, they are even cheaper than jamjar and coast2coast! The extras i want are the panoramic sunroof (which i havent got at the mo, but really like the look of), the two tone leather interior (got the cream leather interior in my stilo at the minute and it looks great), also want the sideskirts as i fink they set the stilo off really well and then just the volumetric alarm; which i take it is the 1 in the brio catalogue! took me claws off before they took me car; so wont have to invest in a set of 17's if i lose it! Fink i can be quite cheecky when i haggle the price down with my dealer as ill be paying in cash or bankers draft!

10-12weeks ent to bad; but 8weeks is alot beta!!

i'll put a post in the thread tomo, to let u guy know what the outcome is?!
 
Woohoo!!

Auction over on friday and what has actually happened is the finance company that are selling the car at the auction have put a high reserve on the car as they need quite alot of money back on it! But the garage was the highest bidder, but didnt meet there resverse; so kinda whats happening is the car is going back in the auction on wednesday without a reseverse and will be released that day to the highest bidder; and the garage have put a desposit on it for there bid, which is only 500squid under what i paid for it! I insistead i went wiv em as i wanted to drive my car back and not have them thrash it, after its been standing for three weeks; so im going on wednesday to pick it up basically!
