When the law came out when I was a boy, there was an objection to a zero limit because some people apparently have an alcohol level even if they haven't been drinking. Therefore a level was set to allow these people to continue driving.

It was never envisaged that people would drink up to this limit.

The message is, after all,

'Don't drink and drive'

not

'Drink a few and drive'

Drink driving is wrong. If i know i need to drive anywhere, i stay away from anything that might effect my judgement. And if i know if i need to drive the day after a night out in town, i dont drink half as much. Its not right risking peoples lives just because i want to drink, so i dont.
 
The limit is above what can be possibly made naturally in your body, well above, some countries in Europe have a relative zero limit - that is a value accounting for what can be made naturally but nothing else. Fair enough, IMO drinking and driving should be muturally exclusive and links like that prove that case. Some of the worst offenders apparently have been people drinking late into the evening (i.e. morning) and then driving in the morning still with the affects.
 
I found this after having a good look through web as I seem to remember this was the defence used by a top lawyer in getting many professional footballers off with drink drive charges.

"High protein diet as a DWI defense. A driver had drunk driving charges dismissed by arguing that his .10 alcohol level was caused by a high-protein diet rather than by excessive drinking. The high-protein defense was based on the theory that the human body produces it’s own alcohol if carbohydrates are suddenly consumed after being eliminated from the diet for a prolonged period of time. A professor of organic chemistry testified that a person’s body produces ketones after a long period of fasting or carbohydrate deprivation. If the person consumes carbohydrates, the body creates amino acids to break down the carbohydrates and make the ketones less toxic. One of the byproducts of this process is isopropyl alcohol, which the body eliminates through the kidneys and lungs. The breathalyzer does not distinguish between isopropyl and other types of alcohol in the body."

Just goes to show that with money & a smooth lawyer that knows about this you can flought the law should you wish! (n)
