finding out when signing the paperwork for the house that it has a restricted covenant regarding using the property to run a business..... thats not good as I'd be working from home!!

you buying or renting? If renting then the landlord should waver that if you ask nicely!
Ours said no children or pets, but we asked and it was changed:)

cant go 'out to work' as it'll cost too much for childcare, so need to work from home, but could end up not being able to due to the covenant :rolleyes:

could pay an indemnity or ask planning and pay £300+ vat and wait months then still be told cant do it!

buying, as renting i've always asked if can childmind or have pets.

i jut gone to get in the mk1, but the battery has died and i had to climb in through the boot, i now trying to charge the battery up so i can set the alarm on it again. think ill have to take it for a drive round the block

first thing to do is find out if other people have managed to remove the restriction from their deeds.

restrictive covenants "run with the land" so in theory they are permanent and apply to all people in all circumstances. when you amend or remove them it is the process of "nullifying a restrictive covenant". generally you need 100% of the people in the affected area to all agree to the change. in your situation that may be all the people who appear on the deeds to the property, or it may be all the people in the street/estate/compound/building etc depending on the situation.

the funny thing is that many restrictive covenants can be ignored because it is only the covenant holder that will be able to do anything about it if you break the restriciton, and in most cases the holder is dead. in many cases the holder is automaticaly appointed, for example it could be the person living across the road, and no matter who currently owns that house only they can give you authority to remove the restriction. its a funny old game.

if your deeds dont say who the holder is, you should contact your local Land Registry office to obtain the contact details of the covenant holder so you can try and obtain their consent to remove it. obviously this process isnt free, especially if you use your conveyancer to do it.

i have a restriction against parking cars on my land, but i ignore it because the holder is dead. its better than paying money, you dont need to please a dead person.

You should be fine just working from home. Its just there to stop people running full scale businesses out there houses.

its not something that could be run just out of a bedroom and no-one none the wiser, think having kids running around outside and parents twice a day may make people notice what's going on. If it wasnt noticable then I wouldnt care!
 
Just phoned garage to book swifty in as its making an annoying creak noise from the front springs everytime I go over a came change or go through a compression or hit a big bump. :mad:
 
its an 'ex council property' which the council put the covenants in place when they sold the properties off.

we're not willing to spend loads of our savings to try and get the lengthy process started as it could still end up negative.

well it was just a silly mistake what caused me to wheel spin
basically i thought i wasn't in gear and so holding it on my break my car crept forwards causing me to press accelerator to keep it going forwards with oncoming traffic in my confortable crossing area.
