I think the smoking ban is great not being a smoker i hated going to the pub or a restaurant and having people smoking there. I cant stand it not very nice for people to go into a reatuarant and have people smoking next to you when your trying to eat.
Surely you can last a few hours or an hour n half without having a fag!!!
 
According to Smoke Free England, there are 4 kinds of places accessible to the public. They are: Totally enclosed, substantially enclosed, partially enclosed and un-enclosed, or open. When you start to look into what these places are, but the first and last are pretty self explanatory, A substantially eclosed space is (roughly speaking) one with a roof and at least 2 sides. What needs to be considered is: Do the walls make up more than 50% of the sides? For example, a building 20' X 10' X 20' X 10' with the walls being 20' and the openings 10' would be a substantially enclosed space and therefore it would be illegal to smoke there. If the openings are greater in area than the
walls then it would be legal. The openings can't be windows or french windows. Sometimes the whole thing gets a bit daft. A plumber (or possibly an
electrician) was fined recently for breach of smoke free legislation by smoking in his works van as was his passenger. The daft bit is that it was his own van,
the only people who ride in it are him and his assistant who also smokes. As post script, I've recently found out that 3 old friends who I'd lost touch with had died. 2 died from kidney and liver failure following 30 years of excessive drinking and the 3rd, also had a touch of black humour about it. He was waiting for a flight home from Spain late at night. He felt a bit drunk and went out of a side door for some air. Unfortunately, he fell just as he got to the automatic sliding doors. You might be able to see this one coming, but as he got near, the doors opened and he fell flat on the floor with the doors then
closing in his neck; then opening again before once more closing on his neck and so on. By the time he was found the carotid (I think) artery was damaged
limiting blood flow to the brain until he died. I don't personally know anyone who has died as a direct result of smoking, although I'm sure there are many.
 
The exact limit to the legislation seems a bit smokey and hazy in this context - *boom* *tish*! (sorry! :eek:)

Aren't there some weird laws that private member casinos can still allow smoking? Maybe that's what's covering a lockdown?

i also wondered if, you could open a bar, and just invite people to come in, then it would be private so it isn't in a public place, not sure about the sale of drinks though.
 
well it's not open to the public anymore so i think it's fine

uhm, not sure, if they host a private party can people smoke?

if they close the pub and entertain friends i know they can.

not sure about smoking in the work space, different thing but people who work on houses and stuff may come accross people smoking indoors in their own home.

really not sure..

dont wish to start an argument but it is illegal any premises that allow access to the public this even includes back rooms that the public cant enter. for example my dad was given a warning for smoking in the back room of his shop which is separated form the public by two doors as it was still on the same premises.

I love it a year on from the smoking ban. Its nice to come home not stinking like an ashtray, have stinging eyes or coughing my guts up the following morning.
 
that is technically illegal even if its there own private living quaters. it is still on a premesis in which they allow the public.

If it's private then it is not a public area. I think. Here's some legislation but I'm too tired to make sense of it all!

Application of Part 2
2. The exemptions in this Part apply only to premises that would be smoke-free under section 2 of the Health Act 2006 if those exemptions had not been made.

"Private accommodation
3.—(1) A private dwelling is not smoke-free except for any part of it which is—

(a) used in common in relation to more than one set of premises (including premises so used in relation to any other private dwelling or dwellings); or
(b) used solely as a place of work (other than work that is excluded by paragraph (2)) by—
(i) more than one person who does not live in the dwelling;
(ii) a person who does not live in the dwelling and any person who does live in the dwelling; or
(iii) a person (whether he lives in the dwelling or not) who in the course of his work invites persons who do not live or work in the dwelling to attend the part of it which is used solely for work."

i smoke, but i'm very much for the current smoking legislation. its made going out for a drink so much better.

i think the smoking sections that have been made are a great addition, for example loads of balconies and new outdoor areas have been created to cater for smokers. these places are a great chance to get away from the music to have a chat with people. when stood in a smoking area i meet and talk to more people than anywhere else. they're great.

yeah i never thought of it like, usually the only place i speak to people if i'm in a club is in the smoking area if i'm standing with mates smoking.
 
smoking area's round here have their own heaters and stuff they are better than inside:p

theres still a few clubs and events where people smoke inside most of it is green though.

i went to Malia for 2 weeks and you can smoke it clubs out there in fact they gave you free fags so it was hard not to.
