I bought something on ebay last week, I collected it last night on the way home from the sorting office and when i got home and opened the parcel the item was broke.

I paid £9.00 postage for this item and it cost me £15.00 altogether. The item hadnt been carefully parcelled up, so i emailed the seller with a picture of the broken item. They offered to refund me £3.00 I have said no!

How liable is the seller for this? If they refuse to refund me could i claim through paypal.

Its bugged me cos they hadnt packaged it properly and at £9.00 I would expect it in one piece. (n)

right lets break it down.
whether rm pay out or not is irrelivent.

did you pay via paypal? you can file an item not as descrbed dispute.
the bad news is for a full refund you would need to return the item.(at your own costs)

did you sign for the item?

its naughty but you need to decide what you are claiming.
claim for item not as described and take a risk and return postage costs
report item not reveived and get a full refund.
paypal require proof of delivery not posting.

as for the seller,the packaging looks insufficient to me and they may not get a payout from RM
