hi guys last night i had a crash, wal pulling up to a stop line fdoing about 5mph, but as i braked the car slid accross the give way line and protruded about 1m into a main road, and was hit by a merc :bang:, front right of my car and whole front to her left side.

basically im trying to sort things out through insurance, but i want to repair it myself, (because time is a factor)

so i need some advice on what parts i need to buy to replace, below are some pictures:

im only TPFT, but am going to push to get it sorted on other parties insurance.

in peoples opinion what do you recon is the best next step to take? concidering i do want to take thru insurance as the damage to the merc is massively more expensive so will be taken from my insurer i belive, so already gna loose any ncb.

anyone know what the plastic stuff behind the bumper is called? ima strip it down and take pictures....

picked up a healamp and bonnet today, i know the bonet in 3 & 5 dr are the same, but are the headlamps? and is there any way i can tell which 1 i have??
 
BUT the guy that hit you should have been prepared for it.

Give way line means you give way. What should the other guy have been prepared for?

And what says that the other party didn't also hit ice and keep sliding making the collision unavoidable?

3 and 5 door headlamps are different.

Post a pic and I can tell you what type of headlamp you've got. The 3-doors is alot more pointed in the corner that goes into the wing.

Loads of 3-door headlamps on ebay though.

Not wanting to be an arse, and I'm not trying to be funny at all, but how do you expect to claim off of the other partys insurance? You went over a give way line. So your fault (even if it was caused by the current weather condtions which makes me feel even more as its something that couldn't really have been avoided (n)).

Hope you manage to get it sorted mate what ever way it goes. Looking as the pick's as a min you'll need;

crash barrier/bar
little plastic clip that goes under headlamp (often missed out as its a litle thing) (possibly same for pass side also depending upon how bumper was ripped off)
wing
bumper
headlamp
bonnet

you lot have got to understand, that i slid maybe half a meter over a giveway line, she saw me 50+ meters away...on her road there was no ice, it was well gritted and dry, main road high high day time usage, so well driven on. the only reason i stopped is because my tyres hit the main road. but in the 50m window she had, she took no evasive manuvers at all, she, in her own words "sped up". there was a whole empty lane on her right, if shed moved accross by 1m she would have easily avoided me. she didnt even brake, because i saw her brake lights come on after she left my car.

im not holding out for anything, thats why im already buying parts, but any sort of compensation would be pretty good, many people (who have seen the junction) have said that if they were driving the merc they wouldnt have hit me...

its more depressingly annoying than anything else....

ill post up a pic of the headlamp when i get home, ill also go take some pictures of the scene in the day time and post them up....
 
understand clearly
you should have used your gears to ensure you could be stopped before the give way
twist it all you like but you went through the give way.
give way to the right,remember?
we all make mistakes,i had a small slide exactly as you describe just yesterday(thanks for not gritting anywhere Edinburgh council) but was going slow enough i didnt go over the give way
 
The reason you can claim on his insurance is you mearly slid out from a juntion, he hit you. He was on the main road he should have had an eye on feeder roads, he had right of way but that doesn't let him off with hitting you.

You'll probably find that the insurance firms will want to split 50/50, but thats only because they are money grabbing scum whom don't care for those they insure.

I doubt it, although I strongly agree with the last part here.

Short of finding several independent whitesses, or even better CCTV footage, it'll most probably be settled in the 3rd partys favour (n)

Another case of where an incar video recorder would have probably helped to save the day in regards to backing up op's story.
 
in a couple of hours ill post up a pic of the junction from google maps, i was going at less than 5mph (crawling in 1st gear), because conditions were poor and ungritted....there was nowhere for me to build any speed (youll see from the road layout)
honestly, i know it sounds stupid, but i dont think there was anything i could have done to avoid the accident bar taking a differnet route/not driving.
im hoping that when the insurance companies see the road layout they will agree with me and go 50/50 split...
but i did definatley cross that line.....

ok ill explain a lil,

i had just come out of the turning at top of picture, with its name half obscured. stopped at stop line and pull off towards the a110, and at that stop line (going very slowly on approach) it slid under breaking till my nose was level with the bus stop markings.
she wa son a110 coming from roundabout from the left of the picture, i was stationary before she hit me, when i had stopped she was jsut before the pedestrian crossign gap in the railings in the left hand lane.....

i think that she had more than enough time/space to move over half a lane or brake to stop if shed been going at a sensible speed (she wasnt)
she was going at such a speed that she ended up in the bus stop after the collision, she didnt move over to the right at all (at collision point), which fortifies that fact that i was stationary.

now it should be evident that no ammount of downshifting would have slowed me down to stop, as i was already in 1st, crawling upto giveway line. also worth noting that the approach from bramley road to giveway line is a decline towards the a110 which didnt help....

If your nose is sticking out beyond a giveway but you've stopped then you won't be to blame. On many roads you have to stick your nose out to see. If someone see's you miles off then accelerates into the side of you, the first thing i would do is call the cops.

The other driver, and yourself will be breathalised. No sane human being would see a car sticking out then slam into it intentionally unless they were either a. not paying attention, or b. under the influence.

I still think a 50/50 will be the best you'll get though, especially as you didn't call PC plod (they can be helpful sometimes).
 
wish i had been thinking straight at the time....i would have called police, they could have sorted it out....im basically waiting for the claims advisor to ring me back, so ill post back tomorrow presumably after ive spoken to him....

can anyone put up a pic of the 1.8 rad support, basically all the platic bits at the front are smashed :(.....just want to know what to ask for and where to find it....
and yes bumper support has folded, will need a new one, are these common to all stilos?? same q for plastic stuff at front.....

Sorry, but that's 100% your fault :(

The only possible defense is if the other driver was driving dangerously (i.e over speed limit and out of control) is to concoct a story that you were pulling out of the junction at the time and the other car wasn't in sight.

Having only TPF&T just makes it even more hopeless as your insurance company will just be hoping they don't face a claim.

If you feel really strongly about it you could counter claim when her insurance company claims repair costs from you but I wouldn't advice it as it could go badly wrong.

Best you can hope for is she doesn't claim either.
 
Same thing happened to me, I came to the end of a residential road, didn't brake hard, but gently and firmly, pumping the brake pedal to a rolling stop. Got to the end of the road, as I went to stop, skidded out onto a major A (by A, I mean "A classified") road.

Car behind with a woman and child skidded except she spun round, I almost got rear-ended but luckily she controlled it, so chaos was avoided.

Luckily nothing was coming on the main road, (that's a rarity!).
 
well i spoke to them today, and explained it all....just got to wait...seems chassie is bent, guy at body shop said he can pull it back into line for £150...hes giving me a quote to give my insurance company if they need it, and ima start the long repair process tomorrow :( i do realise itll probably be settled in her favour....but one can hope :(
