Friends car just failed MOT 'on something leaking' so certificate expired until work being done on Friday. She said her insurance co. have said she is still covered to drive, surely this can't be right? No MOT means car not road worthy if you crash they won't still pay out will they?

A mate said if stopped by police they can do you for £1k no MOT and also do you for no insurance as it wouldn't be insured!

Anyone know facts?

You're allowed to drive the car to and from a pre-booked MOT test but that's as much as I know.

If her MOT has expired or deemed dangerous before the expiry date, I can't imagine it being legal? Happy to be proved wrong.
 
If you get a MOT test before the current certificate expires then the fail sheet that will accompany that doesn't affect the current certificate.

Just some info for reference but I'd always wondered about the original question as I have no trailers or clones of me to tow my car to any MOT place LOL.

Liam, the above is only true though I assume if the car wasn't stated to be dangerous? Just a thought anyway.

Serin, Not necessarily true. You can only drive other people's cars if there is a clause stating so on your insurance certificate. Not all policies have this addition.

Ref. the MOT - has the old one run out? you mention 'failed so certificate expired'. If you still have a current certificate it's ok to drive AS LONG AS the failure wasn't some major safety item.
 
With regard to being allowed to drive your car to the MOT centre if it has run out. This all depends on the person dealing with the claim as the claims handler makes the decisions. I have dealt with similar claims at work and have judged it on speaking to the person who was driving the car. If they were a **** you tell them they are not covered if they are nice and polite to you then. Yes I would deal with their claim. It all depends on the person.

A bit of advice for you is a insurance assessor has to come to view your car or house etc after an incident be nice to them as they are the ones who value everything!

I wouldn't risk driving the car myself. I would only drive it to the test centre. The person who said on the phone that it doesn't matter if you have an MOT was wrong it does matter.

The car will be insured against fire and theft, while on the drive or in garage, so in that respect it's still insured. I would imagine it would be insured while travelling to a pre-booked MOT. Whether it would be insured while driving around without a current MOT is doubtful, ansd it would give them a very good excuse not to pay up.
