I got a parking ticket the other day for parking in a perfectly reasonable way. There were no double yellows single yellows or resident bays, i was parked close to the curb, not even on the corner that i was told i was "unneccessarily obstructing" and my car was smaller than all the other cars around me which didnt even get a ticket. I am taking them to court on it as it is just taking the weee! I wish i had had a camera to hand as i couldnt sent them proof. I think they'll probably drop the charges unless they can some how justify their rediculous claim. Its just unacceptable that these traffic wardens think they can get away with it. Theyre praying on people that would just give in and pay to avoid the hassle. NOT ME! :devil: It may be only £30, but its my £30 which i could go home and back with.

Rant over, i have attached a plan of where i was parked, what do you all think the chances of them backing down off this?

Yea Panda, I'd dispute it too. Take your car back to the place and take a photograph. - To show what situation you were in. I've done this before and they dropped charges. Although I was given a ticket in a Tesco car park and charged £30 (by EUROCAR PARKS) but they raised it to £60 as I'd refused to pay (they also marked the ticket with the wrong date!) which I argued made the ticket invalid. By they still wanted my cash. :mad:

So I a spoke about this in work to collegues. One of the heads of service had a document that agreed, when tesco built the car park way back in 1991, It was to be used as a public parking location, aswell as for tesco customers. I got a copy of this and sent this to them with a 'nice' covering letter. They dropped charges and wrote back saying they were not aware of this clause. and never got any cash!

Awesome! I shall take a picture when the snow goes away as it wasnt snowing when i got the ticket. I've already sent away the dispute part so hopefully will get a nice letter back saying charges dropped due to lack of proof, etc.
Nice to hear its not just me thinking it was a bit out of order.

Even get a few of your mates to get there cars to park where the other cars were. But put the ticket on yours. Take a photocopy of the ticket and take a photocopy of the picture or get an actual copy. Send it to them with a letter, if they reply, saying they want cash - say you are retaining the originals for legal purposes and are willing consult a lawyer on unfair grounds under the Road Traffic Act 1991.

Well done to whoever gave you a ticket, dumb place to park IMO.
 
It's a dumb place to park (depends on the actual layout, I am going by the simple picture) but worth a ticket? Probably not.
 
You say they were no yellow lines, so long as they wern't any, no signs with stopping and waiting limitations, no solid white line then they shouldn't have a case.

Check the highway code. Rule 215 (p55) lists the restrictions. However Rule 217 (p56) specifically mentions not parking on a bend. You need to prove you were not actually on the bend and define where the bend starts and finishes.

Yes, thats what i thought. And i wasnt on the bend, i was after the bend so i think that the guy mustve had a bad day or something (an achievment by 10am lol). I have to admit i was not aware that it was not legal to park on bends though, but as i wasnt parked on a bend and there were no double yellows they dont have a leg to stand on! Also what can you define as a bend that your not alowed to park on, as ive seen plently of parking bays on curved roads or bends :confused: Have to wait and see how anal these idiots can be i supose! :rolleyes:

I checked yesterday and it's not covered by either of those. It may be a by-law or there may be something else which prevents obstruction?

Yeah, its an awekward one. I certainly wasnt obstructing traffic. My car is only very small. And none of those conditions seem to fit with my case. Well tbh they could go either way on this. Can i ask if its my word against theirs can they win? innocent till proven guilty is what i thought the law is, but who knows, after all traffic wardens are above the law :p :rolleyes:
