An incident happened today where my dad received a letter through the post from an accident claims company saying that he has given whiplash to a passenger of ''vehicle x''

We both, scratched our heads as to how this has happened and went to 'the scene of the crime' which happens to be outside our local shop and asked if they have CCTV and has anyone complained about an accident. They replied with yes and the driver of the van went into the shop and said ''I'm claiming for whiplash for the passenger'' asked the lady behind the counter of shop for the footage to which she declined because the incident was very very minor and knew he was after creating a fraudulent whiplash claim then went onto to say they've looked at the CCTV and clearly shows my dads car very lightly leaning on the van.

The CCTV showed my dad reversing into a tight parking space (the ones where you have to go back and forth, back and forth to squeeze in) and he reversed really slowly and lightly tapped/lent on the van behind him, he was doing no more than 2MPH, No damage what so ever caused to either vehicle. 'Passenger x' in renault van took my dads registration number and claims whiplash.


There is no way this could have caused whiplash and the lady behind the counter also said that she 'injured passenger' came into the shop the next day full of life, showing off her new spray tan.

What happens now?



*Forgot to add, the driver said there is no damage to his van.

Insurance companies like to use the damage to vehicles as an indicator of the likely severity of any whiplash claim, no damage to vehicle = unlikely to succeed in any claim.

How can you claim whiplash if you're unable to even prove a collision? If I were you're dad I would deny all liability and that you are aware of any collision having taken place it will then be necessary for the other party's insurance company to be able to prove significant enough mechanism for an injury claim, not easy to do where there is zero damage to either vehicle.
 
:yeahthat: Deny all knowledge, no damage etc etc.

If he does admit to even nudging the van they will have a case for whiplash, regardless of damage or not. Stationary / slow moving vehicle colissions are full of unknowns which can in very few cases cause sever whiplash, looking / sitting to the side etc etc.
 
Write to the second parties insurance company informing them you have will be reporting this attempted fraud to the Police.

Worked for me.
 
It appears that its the passenger whos claiming the whiplash, not through the drivers insurance but through their own accident claim solicitors and after abit of digging into them both it appears they are both boyfriend and girlfriend.

No details were exchanged, only time we knew anything about it was today when the letter came through.

We're just a little annoyed that people would lie through their teeth when they know fully well theres no damage to themselves or the van. Its just their way of earning a few quick bucks!
 
3rd parties insurance are probably not even involved so completly pointless tbh.

Exactly. I got a nice letter back from the insurance company saying they didn't know anything about it and their client was not making any injury claim through them. They also wrote a letter to their client and the claim was dropped within days.

Haha deny it, let them take it to court. Get what you've said about them being BF & GF infront of the court and it'll get thrown out. Bloody frauds.

You might then want to counter claim for stress etc. lol.
