Just had to go out, got phone call from son asked if i could go down to macky D car park because a bloke had reversed out of a space and said my son was driving too fast, i got there the guy seemed a dit agressive was saying he didn't think my son was insured or moted so we shew him the documents, then he insulted the car saying its a pice og crap and he wouldn't have drove one when he was young, he kept saying he's got protected no claims and didn't care about the insurance claim. then he changed his story and said if my son got a resonable quote he would pay for the damage without going through the insurance, After he had gone a young couple came up and said they had seen the whole thing but were frightened to come over because the man was agressive,they said my son wasn't moving at the time of impact and they could see his brake light were on,
my sons car has a big dent now its a 2 door the dent is on the bit between the front door and rear wheel arch. i am thinking that we might as well go through the insurance as we have a whitness.
what do you lot reckon?
the other guy was driving a audi i could see no damage to that other than paint on his bumper that would t-cut out.

i would go through insurance, if the guy has 'protected no-claims', what has he got to worry about.

my mum had a similer situation when she was driving my dads car, she nudged another in a car park, there was no damage to either car but the wmona insisted that her bonnet was out off shape and accusing my mum off all sorts.

the woman called the police and my mum had to wait there for over an hour, when she phoned me she was quite distressed and upset cause shes not the type of person to lie and she admitted that she nudged this woman.

nothing ever happened about it, but people try it on, the guy coming out the space should give way to passing cars, its common courtesy, even if he didnt see your son, he shouldnt be fretting over it like this, are u sure that he had all the relevent paper work

Dave; seems like you may have had a lucky escape and it could have turned out nasty - i would take it so personally if somebody reversed into my and basically said it didn't matter because I drive a crap car!

I wonder if he is trying it on because he doesn't have insurance and wanted to sneak out of it?

I think the best advice for anybody in such a situation (if they can't rely on nice dads to come and help) is to phone the police. You have an independent witness (assuming you have their details) so go which ever is cheapest for you?

He gave his name and address and phone number and regestration, he said he is insured with norwich union, same as my son.

there was no need for police no one was hurt, i managed to calm things down quit quickly (i was bigger than him;)), got the whitness address and phone number, they said he was a lot more aggresive before i arrived.

You probably calmed him down for just being there which is good. NU will sort it out very simply being one insurance company (you would hope!); independent witness will mean he is affected, not your son. I guess your son was easy pickings for a man who had just damaged his nice audi by tapping into what he considered a shed in his way, i mean who has the right to get in his way?!

I love his initial excuse "you were driving too fast", ok how fast can you actually go in a small carpark? If a person is coming up to you quickly anyway, you don't reverse and then blame him for coming too quickly! People these days!

I only meant about the police if you have an unhelpful party involved/they are getting agreesive/you're getting wound up/feel threatened etc.

Hope you get it sorted easily.

Norwegian rule: If you back into a car it's your fault.

No matter what situation - even if it isn't your fault. So you should manage to fight through a winner here. Get the insurance company tax the damage and claim the money. Get someone else to repair it "after work". Money for everyone...

Seems to me Dave if the bloke wants to settle without insurance if he's happy to pay for the damage just let him do that it's the easiest thing all round. If he won't pay then you can go to his insurance/involve the police.

If you go through the insurance company will your sons insurance go up as a result? just a thought, i know it shouldnt but you never know with insurnace companies. I would try and find the most expensive place to get the car fixed, then the cheapest. Charge him th most expensive, take it to the cheapest and pocket the difference for having to be put out :)
If he will not pay up then go through the insurance company.

I was involved in a crash 2 yrs ago, I was driving down whitworth road towards rochdale and I had to pick my brother up, so I usually wait in a certain carpark for him.... I signalled right to turn up a side street and when it was safe (so i thought) i started to turn and the next minute a taxi driver from behind had been bombing down the road and coz he was going that fast he tried to swerve around me as in in front and smacked into the side of my car, he pushed my little punto a good 10ft down the rd (sideways). The whole divers side of the car was badly mashed!
The police arrived and he told them i had been doing a U turn in front of him- what????
I now have a pro-lasped disc in my back and have been to physio, i am taking this guy to court! I have had my NCB frozen until it gets sorted out!
It took him 6 months to give my insurance an "independant engineers report" he reckons there is over 5 grand worth of damage to his car, it was a N reg toyota carina, or corolla! even my insurance put on the records it was a dodgy claim. especially since it was just a bumper and a front wing that he'd damaged.... hmmmm

No its still all going through, I have not claimed for any compo - although i wish i did now but i just wanted my NCB back. This guy is claimimg for everything, he reckons he hired a replacement car for 14 days, for £110 per day!!!! I was a right mess after it happened, all my back was bruised, and i couldn't walk! The doctors said that because i was hit from the side it put major pressure on my spine because the spine is not meant to go sideways!

To make matters worse, straight after the accident he got all his taxi driver mates to turn up and come and suround me and they were shouting stuff out at me in hindu or whatever, i was really scared!:(

its worth getting the insurance involved as IME getting the money for repairs is more hastle than its worth.also if you end up involving the insurance at a later date because you cant get the money it will double the hasstle

sorry to hear that sammiboo,side impacts are the most dangerous by far as the human body just isnt designed to travel sideways at speed

Thats terrible, when someone has an accident all they see is how much money can i get fromn this and try it.
sammi did you have any witnesses?

my dad had an accident years ago he pulled out of a junction and hit the side of a car on the main road, obviously my dadas fault, but there was no damage to dads tipo just a mark on the bumper along with some paint. the person he hit tried claiming for a new front wing, front door and rear door! he didnt get them though!

hope your claim goes through ok though.

Chris - yeah i had a witness, but my solicitor cannot contact him, i have been to his house loads of times but he is never in and i have even posted letters through his door - it really upset me because he saw everything and even told the police he'd act as my witness. I am not out to get loads of money like the taxi driver is i just want to prove he was in the wrong!
