To be honest I'd be looking at trying to get the council to accept responsibility, or at the very least offer compensation for it.

Unfortunately I can't help any. Keep at it and see how you do. At the end of the day, you've nothing to lose by challenging them. I hope you get it sorted, because I know I'd be gutted about it.

Not sure if it's something you'd consider, but if you've got some time you could always pop into a Citizens Advice Bureau and see if they can be any help. Again, not sure how easy that is, or whether they'd be any use, but just an idea!

Well its been over 18 months since the incident but this has finally been resolved so thought i'd provide an update to close out the thread.

It turned out I did have some legal cover on my insurance but this was useless on 2 counts. Firstly, the cover was only for personnel losses which meant they would try and claim the cost of my excess and any other costs (such as car hire if I had it) but my no claims would still have been effected. Secondly, basically they just sent a letter to the councils insurers asking for money and when they replied querying a few things they just gave up! I guess there is very little motivation for them to pursue cases.

So I had resided to the fact that I would just have to live with it as I didnt want to employ my own lawyers, but out of the blue about 8 months ago I was contacted by Elephant. They said they didnt consider me to be at fault for the incident and therefore they were going to pass the case on to their own lawyers and if I would be willing to attend court if necessary. This was good as if they were successful I would get my no claims back and also the excess I had paid. Anyway, I found out this week that the council had settled which I was really happy about. Also as I had my no claims discount back Elephant refunded me 150 on my latest insurance premium!

Ive been with Elephant a few years now and I must say im reasonably impressed with them. There customer services is good and if you ring up when your insurance is up for renewal and beat them down on price I have found them to be very competitive on price.
