I had an accident last year where a van drove into me on a roundabout, I paid my £400 excess and got the car fixed.

on my insurance statement I explained that he drove into me and they tried to get the mney back from the other insurance company (it was a works van so insured under the companies name).

This didn't work so it started to go to the solicitors and they couldn't get the money back so I signed court papers about 5 weeks ago.

2 days ago I received a letter from the solicitors saying that the company has been bought out, changed it's name but they haven't taken on any of the liabilities so there is no one to claim the money off anymore :bang:

Now I rang tesco and told them that I'm not bothered about getting my excess back as that's an expense that they have had to pay out and not got back, but at least give me my no claims back?

I asked the bloke on the phone how can I prove that I was not at fault and the answer I got back was "you can't" (n)

So now I am going to make a formal complaint through tesco and explain to them that if I do not get my no claims back then I will make a complaint through the financial ombudsman scheme and this will cost tesco money so it is advisable for them just to give me my no claims back :slayer:

The situation you are in is ridiculous.

Stand your ground and get the guy in court straight away.

If you are aware of the van drivers registration plate, the police can track his identity for you and arrange a court date. (as long as you state a valid, law-abiding reason)

The other person's insurance company were still the insurance company at the time of the accident no matter what has happened since, should still have an active file and are ultimately the people you have most chance recovering from.
 
I have the drivers name and the reg plate, the solicitors are the insurers appointed solicitors.

I kept getting letters back from the insurance company and solicitors saying that letters they sent to the third party were not being replied to.
 
Right got more info on this now, the third party never replied to any letters or telephone calls, my insurance company even sent people round there only to be told that "the person who is dealing with it is not available" yea right :rolleyes:

my insurance company don't even now if the company was insured or not??? so they can't claim anything back then I am classed at fault.

I'm now going to make a claim through the Motor Insurance Beurau and see if I can get anything that way..
 
hi mate, im a claims adjuster myself.

in short, if you present your claim to the MIB they will most certainly deal with it, i cant see them refusing to if im honest.
